Legislation cannot be immovable

The Constitutional Court held a meeting on the results of the work of the highest body of constitutional review last year. There is President Vadim Krasnoselsky, Deputy Chairman of the Supreme Council, Head of the Parliamentary Committee on Legislation, Defense, Security, Peacekeeping, Protection of Rights and Freedoms of Citizens Galina Antyufeeva, Deputy Prime Minister Stanislav Kasap, executive bodies of the Prosecutor’s Office, the Supreme and Arbitration Courts , employees of the Constitutional Court are among the participants.

The first decision of this body was made on May 27, 2003, and for almost 16 years it has stood guard over the Basic Law of the country. Particular attention is paid to the transparency of its activities. For example, it is the only state body in the republic.

This year, 18 appeals were received, 16 of which separate complaints (8 deviations) and two petitions of the Supreme Council. It is a process of final application. They were identified as public authorities. In this regard, two decisions were taken, adopted in 2003 and 2005.

Rejection of the decisions of the Constitutional Court of 2003 and 2005 allowed, firstly, to reflect in the Basic Law the place of the prosecutor’s office in the system of state bodies, secondly, to amend the basic law “On the Prosecutor’s Office of the PMR”, returning to including maintaining on behalf of the state charges in the courts.

In this regard, the prosecutor of the republic gave an example of an intensive lawmaking process, which takes place both within the framework of the relevant parliamentary committee on legislation and during plenary sessions, which resulted in the adoption of laws that are necessary for society and citizens.

During the final meeting in the Constitutional Court, the chairman Oleg Kabaloyev, informed about the resumption of interaction of the supreme body of the constitutional control of the republic with colleagues from Abkhazia, who are provided with methodological assistance, experience is exchanged. This year, the President of the Constitutional Court of the Republic of Abkhazia is expected to visit our republic.
