The types of special means of fixing offenses are enshrined in the Code of Administrative Offenses

The prosecutor's request for the interpretation of the article of the Code on administrative offenses concerning special technical means of video, photo and film recording became the basis for the development of the law-in-draft. When discussing the law-in-draft on amending the Code of Administrative Offenses in the first reading, the PMR prosecutor Anatoly Guretsky explained that the Supreme Court did not recognize the drawing up of a protocol, which was carried out technically by obtaining information from a video recording by an employee of the internal affairs bodies, which, according to the Prosecutor’s Office, was unreasonable.

After making changes to the Code of Administrative Offenses, the types of special technical means that record administrative offenses on the territory of the republic will be legislatively fixed. The concept of "special technical means operating in automatic mode and having the functions of photo and film shooting, video recording" is supplemented with the following characteristics:

  - devices must operate in a stationary position or on a vehicle moving along an approved route, which fixes in its field of view all administrative offenses for the detection of which it is intended;

- an official of the internal affairs body does not exert any influence on the devices.

The law-in-draft was supported by the deputies in the second reading.
