Clarification of legislation in the field of inspections

Deputies of the Supreme Council are working on changes to the legislation in the field of conducting control checks. The legislations, which were initiated by parliamentarians Alexander Korshunov and Vadim Kravchuk on the basis of appeals from entrepreneurs, were adopted in the first reading. It is proposed to prescribe a specific time period for the work of individual entrepreneurs and legal entities, subject to verification by state control (supervision) bodies. Clarifying norms are introduced into several laws, including the law “On the procedure for conducting inspections in the exercise of state control (supervision)”.

The authors note that state supervision bodies can carry out control measures no more than once every 3 years in accordance with the law. However, the period to be verified is not specified. It turns out that now a scheduled control check can cover an unlimited number of years of activity of an economic entity.

According to the authors of the law-in-draft, the time period for verification should be 3 years preceding the year in which the decision on verification was made for individuals (with the exception of individual entrepreneurs), and 6 previous years for legal entities and individual entrepreneurs. The parliamentarians want to prescribe that the period when the entrepreneur has suspended his activities will not be subject to verification.

The deputies supported the legislations in the course of the plenary session in the first reading. The relevant committee will continue to work on them in preparation for the second reading.
