The Law “On Enforcement Proceedings” may clearly state that collection under enforcement documents is not allowed if after deductions the debtor’s income is less than the subsistence level. The amendments were initiated by deputies of the Committee on Legislation, Protection of Rights and Freedoms of Citizens Galina Antyufeyeva, Gregory Dyachenko and Oleg Petrik. This is due to the fact that there was an ambiguous understanding of the rule of law prohibiting collection for a total amount equal to the debtor’s subsistence level in practice. A precedent arose in this regard when a pensioner was withheld from collecting her pension, the amount of which was less than the subsistence level.
The law-in-draft of legislators was considered by deputies of the Supreme Council in the course of the plenary session. The essence was presented by co-author Gregory Dyachenko.
Amendments to the law “On Enforcement Proceedings” will eliminate discrepancies and ambiguities in the application of the law in practice. The parliamentary corps adopted the proposed law-in-draft in the first reading. The relevant committee on legislation will continue to work on it in preparation for the second reading.
