The Supreme Council of the Pridnestrovian Moldavian Republic adopted in the final reading today a package of legislative initiatives that specify at what level of alcohol in the blood of a driver liability arises – administrative or criminal (in case of harm to health or death of people).
The Code of Administrative Offenses of the Pridnestrovian Moldavian Republic will now state that in order to bring to administrative responsibility for the offenses provided for in Article 12.8 (Driving a vehicle by a driver in a state of intoxication, transferring control of a vehicle to a person in a state of intoxication) and paragraph 3 of Article 12.28 (Failure to perform duties due to a traffic accident) the fact of the use of substances that cause alcohol intoxication can be established by determining the presence of absolute ethyl alcohol in the blood at a concentration of 0.34 ppm or more. The fact of alcohol consumption by a driver was established at a rate of 0.16 milligrams per liter of exhaled air in the Code of Administrative Offenses until now. The determination of the state of alcoholic intoxication is possible both by exhaled air and by a driver's blood test.
A reference norm to the Code of Administrative Offenses has been established in the Criminal Code of the PMR to bring to criminal liability for crimes under Article 260 (Violation of the rules of the road and the operation of vehicles) and 260-1 (Violation of the rules of the road by a person subjected to administrative punishment or with a criminal record) to determine the level of alcohol in the blood drivers.
Changes to the legislation will come into force immediately after signing by the PMR President.
