Elimination of contradiction

Currently, it is possible to recognize the ownership of an unauthorized construction only in court in accordance with the Civil Code. Along with this, there are legislative norms in the legal framework of the republic that provide for the possibility of registering the right of citizens to erected real estate objects in a simplified manner. In particular, such procedure is enshrined in the law "On the system of state registration of rights to households located in rural settlements of the republic, and transactions". In this case, local authorities of the village send the documents collected from the applicants to the bodies of the republican authorities that are responsible for registering and maintaining the state register of rights to real estate.

The authors of the law-in-draft are convinced that the adoption of the legislative initiative will allow to eliminate contradictions between the norms of the Civil Code and the legislative acts defining the simplified procedure for registering the rights of citizens to real estate, and will simplify the procedure for recognizing ownership of buildings erected on the land without agreement and permission.

Initially, the proposal of Vitaly Kalin and Vasily Vlasov found support in the responsible parliamentary committee on legislation. According to Galina Antyufeeva, 12 positive conclusions were received from the subjects of the legislative right.

Despite the fact that the law-in-draft was objected by the deputy Oleg Vasilaty, the majority of the votes in the Civil Code were adopted by the deputy corps in the first reading.
