Timely Payment for Patent

According to the current legislation, individual entrepreneurs can be granted a patent for a year on the basis of a relevant application and when paying for the document in not less than one month. It is possible to extend the validity of the patent without applying to the tax inspectorate within three years. An important condition for the extension is the timely payment of a patent fee - until the first day of the month following the previously paid. However, if for untimely payment of the patent there are valid reasons, for example, illness, departure from the republic, the tax inspection may consider extending the term of the patent. Such a norm was introduced to support individual entrepreneurs. According to the government, cases of abuse of individual entrepreneurs by such a loosening rate have recently become more frequent, and the late payment of a patent fee is systemic. The executive body of the government initiated amendments to the law "On individual entrepreneurial patent" to resolve this situation. Deputy corps considered it in the first reading. The law-in-draft was presented by the Minister of Economic Development Sergei Obolonik in the course of the plenary session. He noted that a fine in the amount of 50 to 450 MW is imposed for violation of the established procedure for conducting individual entrepreneurial activities.

One of the proposed amendments proposes to exclude the requirement that the patent holder provide the application with an indication of the reason for late payment of the patent fee. According to Sergei Obolonik, the adoption of the law-in-draft will help create a mechanism that will not allow to systematically violate the established rate of payment for a patent, simplify the documentary confirmation of respectful cases.

According to the profile committee for the development of entrepreneurship and industry, amending the law will help increase the responsibility of individual entrepreneurs for the timely payment of patent fees, and subsequently limit the number of administrative offenses for the lack of entrepreneurial patent.
