Stimulating factor

Deputies of the Supreme Council Galina Antyufeyeva, Oleg Petrik, Vitaly Kalin and Grigory Dyachenko are the authors of the law-in-draft to amend the law “On Enforcement Officers”. The proposed norm provides for additional material compensation of the bailiff in the form of 3% of the amount recovered or the value of the property. At the same time, the amount of such remuneration should not exceed 20 MW (308 rubles), and according to the executive document of a non-property nature - 15 MW (231 rubles). Payment will be provided from the funds of the performance fee, which is 5% of the amount claimed or the value of the property of the debtor.

According to the State Service of Bailiffs of the Ministry of Justice, today the number of unfinished enforcement proceedings is increasing. At the beginning of 2018, 77 310 executive documents were in production, which is 11.33% more compared to the beginning of 2017. Today, there are 2 thousand court proceedings per one bailiff.

It was possible to solve the personnel issue of the State Service of Bailiffs only by the end of last year. Prior to this, the turnover of workers in this field was observed. Participants in the plenary noted a low level of their wages. The payment of additional remuneration, according to the authors, will be a stimulating factor for increasing the number of timely executed executive documents.

Following the discussion of the law-in-draft, 24 parliamentarians voted in favor of its adoption in the first reading. Work on the document will continue in preparation for the second reading.
