The task of developing a draft Urban Development Code of the Pridnestrovian Moldavian Republic was set by the PMR President Vadim Krasnoselsky several years ago. Work on the draft of the new codified legal act took a long time. The draft was developed and submitted to parliament for consideration in November 2023. The authors were parliamentarians Alexander Korshunov, Anton Onufrienko and Oleg Vasilaty. They note that the need to introduce the Urban Development Code into the legal field of the republic has been long overdue; two laws adopted in the mid-90s of the 20th century, "On Architectural Activity" and "On Urban Development", are still in force in this sphere. The Urban Development Code as a codifying law will regulate all relationships in the field of urban development, taking into account modern realities, according to the authors. This includes the rules of architecture and urban development for individuals and legal entities, principles of zoning territories, legal norms regarding abandoned buildings and premises. The draft Urban Development Code of the Pridnestrovian Moldavian Republic contains norms on major repairs, demolition, as well as on the operation of buildings, structures, defines the competence of state authorities of the Pridnestrovian Moldavian Republic, state administrations and Councils of People's Deputies of district city councils, the role of urban development documentation and urban development regulations.
The Committee on Regional Policy and Housing and Public Utilities worked out the draft of the new code and recommended it for adoption by the Supreme Council of the Pridnestrovian Moldavian Republic in the first reading. The opinion of the deputy corps on the need to adopt the draft Urban Development Code differed. Some deputies spoke out against it.
The proposal of the relevant Committee to adopt the law-in-draft in the first reading and the proposal of the parliamentarian to reject it were put to a vote. The majority of the Supreme Council deputies voted for the adoption of the law-in-draft "On the introduction of the Urban Development Code of the PMR", and it was adopted in the first reading. The deputy corps considered today in the first reading the draft Urban Development Code and 10 legislations that amend and supplement the accompanying current laws. These are amendments to the Constitutional Law "On the Government of the PMR", to the Land and Water Codes, to the laws "On Transport", "On the Status of the Capital", "On Local Government Bodies and Local Self-Government". The draft amendments to the Constitutional Law "On the Government of the PMR" did not receive the required number of votes for adoption and was rejected during the discussion and voting. The law-in-draft on amendments to the law "On state registration of rights to real estate and transactions with it" was rejected at the suggestion of the official representative of the Ministry of Justice. The remaining 8 legislations were adopted in the first reading, as was the Urban Development Code. The Committee on Regional Policy and Housing and Public Utilities will continue working on draft laws in the sphere of urban development in the second reading. About 90 amendments have already been received from subjects of the right of legislative initiative for the draft Urban Development Code, according to Alexander Korshunov. All of them will be taken into account when working on the law-in-draft in its preparation for the second reading.
