The search for legislative mechanisms to solve the problem of abandoned houses continues

A working group has been operating in the Supreme Council for almost a year, whose task is to find legal mechanisms for resolving the issue of abandoned non-residential buildings. One of the points of the tasks set for 2023 by the Supreme Council by President Vadim Krasnoselsky during his Address to the state authorities and administration on January 17 is to continue work on improving the legislative norms regulating the procedure for the alienation of ownerless non-residential buildings and premises.

Each case of abandoned buildings is unique, so there can be no single approach, the deputies are sure. The state administrations are studying situations with existing abandoned buildings and premises in towns and districts. Only a court can deprive a citizen of property rights today, but such a decision requires good reasons.

The process of seizure of property and the court is an extreme measure, of course. Local authorities identify the owner at the initial stages, if necessary, look for him, try to conclude an agreement so that the owner puts the abandoned premises or building in order, makes repairs, or sells it as unnecessary. If the owner refuses, or they cannot find him at all, then the process of withdrawal is launched.

The working group in the Supreme Council of the Pridnestrovian Moldavian Republic on improving, studying and analyzing the issue of mismanaged non-residential premises (buildings) collects and studies all the information that comes from state administrations. A lawsuit began on the seizure of a large abandoned building, which is in disrepair, from the owner in Bendery. The course of events will be monitored and the precedent studied.

The working group continues its activities. Which laws will be amended, whether it will be a package of legislative initiatives at once or separate legislations as information becomes available – the issue has not been resolved either.

Anton Onufrienko noted that there is experience in Western European countries, but the laws regarding abandoned buildings and premises are quite severe there. Therefore, it is practically impossible to apply the European experience to our reality.
