According to the current wording of the law “On Enforcement Proceedings”, if the debtor does not compensate the damage to health or other debt established by the court in time, then the bailiff has the right to recover it forcibly. An additional performance fee is collected from the debtor, the amount of which is 5% of the amount collected or the value of the debtor's property in such cases.
The amendments to the law adopted today exempt non-working citizens from paying the performance fee, who are paid the minimum pension for age and below. This provision was in effect on the basis of the order of the Head of the State Service of Bailiffs of the Ministry of Justice. According to the Prosecutor of the PMR, the exemption on payment for this category should have been prescribed at the legislative level, so Anatoly Guretsky sent the relevant law-in-draft to the Supreme Council for consideration.
Amendments to the law "On Enforcement Proceedings" were adopted at the plenary session in the second final reading. The regulation will come into force on January 1, 2023.
