Peculiarities of distance trading are prescribed in the law

Deputies in the course of the plenary session voted to approve a package of legislative initiatives that will regulate online commerce in the second final reading. The amendments are made to the Civil Code, the law “On the Protection of Consumer Rights” and the law “On Internal Trade”. The obligations of the seller and the rights of the buyer will be enshrined in it.

Pridnestrovian legislation has not spelled out the responsibilities of a seller who works remotely until now, as is done in the Russian Federation, for example. Moreover, complaints about unscrupulous sellers working remotely are received regularly. Most often, the seller refuses to exchange a product that does not fit or does not provide reliable information about the product before purchase.

Sellers at the moment must provide information about the basic consumer properties of the product, its country of origin, price and terms of purchase, as well as delivery, service life, expiration date and warranty at the request of the consumer, even before concluding a contract. The law stipulates the need to pre-agree the payment procedure. The buyer in accordance with the provisions of the Law “On the Protection of Consumer Rights” will have the right to exchange non-food products, refuse the purchase and return the money paid for non-food items if there is a receipt. However, taking into consideration the fact that the goods were purchased online, even in the absence of a receipt or document confirming the fact of purchase, the buyer will still have the opportunity to refer to other evidence of purchasing the goods from a specific seller.
