Land Plot Registration without State Fee

The need to register the right to land and transactions (agreements) with land. Information must be entered into the Unified State Register of Rights to Real Estate and Transactions with it is prescribed by Land Code. However, not all residents of villages and towns register their right to land plots for gardening and personal subsidiary farming. The obstacle to this is the payment of a state fee, according to the Government.

If there are any buildings on the site, this concerns personal subsidiary farms as a rule, then you must pay a state fee in the amount of 9 minimum wages for state registration of an agreement (transaction) with real estate and for issuing a document on this registration. Considering that the size of 1 minimum wage is 14.5 rubles, the amount of the state duty for 9 minimum wages is 130.5 rubles. In addition, a state duty is paid for state registration of rights to land – 12 minimum wages (174 rubles).

Basically, land plots for gardening and for personal subsidiary farming are used by pensioners and those who work on the land to receive their main income and ensure life. The Government proposed to cancel the payment of the state duty for them in order for residents of villages and towns to register their rights to land plots. The law-in-draft was considered by deputies of the Supreme Council in the course of the plenary session on December 11.

The concept of the law-in-draft proposed to cancel the payment of the state duty for the period from January 1 to July 1, 2025. The Committee on Agro-Industrial Complex Issues amendment extended this period until the end of 2025. You need to have time to submit documents to the registration authority during this period. The amendments to the law “On state duty” will come into force on the 1st of January after signing.
