A package of legislations clarifying the supervisory functions of the prosecutor's office, including in cooperation with judicial and other authorities, was considered by the Supreme Council in the second reading. A number of amendments and addendum to the constitutional law "On the Prosecutor's Office of PMR", the Civil and Arbitration Procedural Codes, and the Code of Administrative Offenses were initiated by the republic's prosecutor. As Anatoly Guretsky explained earlier, the legislations streamline the process of implementing the functions assigned to the prosecutor's office to oversee compliance with the Law.
The deputy corps during the plenary session reviewed amendments proposed to the legislations. Discussion was prompted by proposals concerning procedural legislation. In particular, it was proposed to determine the right of the prosecutor to apply directly to the court of supervisory instance, avoiding the necessity of preliminary consideration of the supervisory complaint by the judge of the Supreme Court. The Chairman of the Supreme Court Vladimir Rymar expressed a negative opinion. In his opinion, the prosecutor's office must remain an equal party of the judicial process - granting it a special status will violate the system of checks and balances between participants in the proceedings, that is, it will contradict the Constitution. In turn, the republic's prosecutor Anatoly Guretsky supposes that the current procedure for cooperation between the prosecutor's office and courts is imperfect.
Along with this, the prosecutor proposed to change the procedure for applying citizens to the supervisory instance court in civil cases if the deadline for filing a cassation appeal was missed. Under such conditions, citizens do not have the opportunity to apply for review of the court decision if, in their opinion, a judicial error was made. Chairman of the profile parliamentary committee Galina Antyufeeva gave explanations.
Legislators also agreed with an amendment according to which the prosecutor has the right, if necessary, to demand civil cases from the court.
At the same time, the deputies stated that several years ago the functions of the prosecutor's office were cut. Today, the work is under way to restore it.
