Amendments to the Civil Code: a new article is being introduced

Deputies of the Supreme Council of the Pridnestrovian Moldavian Republic adopted in the first reading law-in-draft that will give citizens the right to choose when paying for utility services: pay current payments or contribute money to debts, and collect debts first of all from the population by utility companies at the legal level. Deputies of the Committee on Regional Policy and Housing and Communal Services propose to make amendments to the Civil Code of Pridnestrovie.

The specialized Committee on Regional Policy and Housing and Communal Services is actively working this year to find legislative solutions to reduce the debt of citizens and enterprises to pay for utility services. The task for this year was set to the Committee by the Chairman of the Supreme Council of the Pridnestrovian Moldavian Republic Alexander Korshunov.

The legislative initiative of deputies of the Committee on Regional Policy and Housing and Communal Services Ruslan Gareev and Anton Onufrienko supplements the Civil Code of the Pridnestrovian Moldavian Republic with a new article 336-1 “Repayment of claims for homogeneous obligations”. The essence of the law-in-draft is to allow citizens, when paying for utility services, to indicate whether they are paying a current payment or a historical debt for a service. If a citizen has debts, has not directly indicated what exactly he is paying, then the money by default goes to pay off previously accumulated debts.

The authors of the law-in-draft note that the introduction of a new article into the Civil Code of the Pridnestrovian Moldavian Republic, by analogy with the Russian Federation, will give the right to utility companies at the legal level to collect debts from the population in the first place. The PMR government sent a negative opinion on the law-in-draft. However, at the plenary meeting, the head of the Committee on Regional Policy and Housing and Communal Services Ruslan Gareev clarified that in working order, after considering changes to the Civil Code at the Committee meeting, a number of issues had already been settled and the Committee received amendments to the law-in-draft, which will be taken into account when working on the project law in the second reading.

The Supreme Council agreed with the opinion of the relevant Committee and adopted the law-in-draft “On Amendments to the Civil Code of the Pridnestrovian Moldavian Republic” in the first reading.
