Institute of public contract in the field of housing and communal services

The contract for the provision of basic housing and communal services will be public. The corresponding initiative of the Government in the first reading was supported by deputies. Changes are proposed to be made to the Housing and Civil Codes, as well as to the law “On drinking water supply in the Pridnestrovian Moldavian Republic”. The draft law provides that contracts for the provision of housing and communal services can be concluded through conclusive actions. That is, citizens will have the opportunity to conclude such an agreement orally. It will be considered concluded from the moment of the first actual payment for the service or the first actual connection of the subscriber to the connected network. It is irrational to conclude a large number of model contracts in writing today as noted in the Government. The majority of parliamentarians agree with this opinion. Conceptually, the idea was supported by the profile committee.

Citizens will retain at the same time the right to conclude contracts in writing. As the deputies note, there are non-standard situations when it is necessary to fix certain technological features in the contract in practice.

The Deputies during the discussion within the framework of the first reading had questions on a number of aspects of the bill. The Committee on Regional Policy, Local Self-Government and Housing and Public Utilities agreed that the law-in-draft needs serious revision. Amendments will be developed that will resolve all controversial issues during its preparation for the second reading.
