The deputies considered law-in-draft “On the procedure for serving an administrative arrest” proposed by the parliamentarians of the committee on legislation. This is a completely new norm for the legal base of the republic. The document during the plenary session was presented by co-author, deputy of the Supreme Council Vitaly Kalin. The parliamentarian in his speech noted that a thorough legal analysis showed the need for systemic reform of the current norm. The fact is that today the procedure for serving an administrative arrest is governed by the relevant provision of the Ministry of Internal Affairs, adopted in 2002.

Proposed in the law-in-draft norms “On the Procedure for Serving Administrative Arrest” concerning the protection of human and civil rights and freedoms are similar to the norms of Russian legislation. The deputy corps adopted the document in the first reading.

The procedure for the adoption of the first reading also passed the initiative to amend the Criminal Procedure Code. Their developers were the deputies of the relevant committee on legislation. The document deals with the establishment of a one-year period during which the prosecutor or the head of the investigative body has the right to cancel the decision to terminate the criminal case. Today, the time frame has not been established at all, and this gives the right to the heads of the supervisory agencies at any time to cancel a rendered illegal decree.
