E-kickscooter riding will be additionally regulated

Deputies of the Supreme Council spoke about road safety at the plenary session on the 4th of December. Riding electric kickscooters while intoxicated can violate this safety. However, the Code of Administrative Offenses does not clearly prescribe liability for this offense. Clause 3 of Article 12.31 provides for punishment for violating the Traffic Rules while intoxicated by a person directly involved in the traffic process, including a cyclist (the fine is 15 minimum wages (276 rubles)).

The Supreme Council deputies Galina Antyufeeva, Oleg Petrik and Grigory Dyachenko initiated law-in-draft on amendments to the Code of Administrative Offenses in order to specify the norm regarding electric scooter riders. It is proposed to establish administrative liability for personal mobility vehicle driving while intoxicated. These include vehicles with one or more wheels (rollers) intended for individual human movement using an engine (electric scooters, electric skateboards, gyro scooters, segways, unicycles and other similar vehicles) According to the traffic rules.

The law-in-draft is aimed at preventing new cases of traffic violations, the authors of the changes noted.

The changes to the Code of Administrative Offenses proposed by the deputies were supported at the plenary session in the first reading. According to the concept of the law-in-draft, personal mobility vehicle driving while intoxicated will result in a fine of 100 to 200 minimum wages (from 1840 to 3680 rubles). Additionally, those who have a driver's license will be restricted from using it for 1 year.

In addition, traffic militia officers will be able to use breathalyzers with respect to such road users, or they will need to undergo an examination at medical institutions. A fine will be imposed for refusing to undergo a medical examination: 150 minimum wages (2760 rubles) with a temporary restriction on the right to drive a vehicle for a period of 1 year.

The specialized committee on legislation will continue to work on the adopted amendments to the Code of Administrative Offenses. Amendments will be prepared for the second reading taking into account the comments and suggestions voiced.
