The Land Code of the Pridnestrovian Moldavian Republic stipulates the grounds for termination of the right to long-term use of a land plot and the grounds for termination of a land lease agreement. Land users are deprived of the right if they use the land irrationally and inefficiently, which is expressed in a 25% decrease in yield over the last 2 years compared to average yields. The exception is cases where the decline in indicators was affected by natural disasters or other natural circumstances.
The government proposed to apply an equitable approach when determining the rationality and efficiency of land use. The law-in-draft introduces amendments to the Land Code, which propose to separately analyze the yield on lands where irrigation is used and where it is not. Deputies of the Supreme Council supported the idea and adopted the law-in-draft in the second final reading.
Lands will be classified as plots actually irrigated and located in the irrigation zone on the basis of a legal act of the Ministry of Agriculture and Natural Resources. Concepts are prescribed in the Land Code for this purpose.
In fact, irrigated lands are lands provided with a constant source of water supply, on which at least one irrigation was carried out during the year or growing season (the period of the year in which the growth and development of plants is possible).
The irrigation zone should be understood as land plots suitable for agricultural use and irrigation, to which it is technically possible to supply water based on the capacity of the hydraulic structure established in the design documentation for construction, reconstruction and restoration.
Productivity indicators, and therefore efficiency of use, will be determined based on the average yield of agricultural crops from irrigated lands for irrigated land plots (actually irrigated and located in the irrigation zone).
The adopted new rules of the Land Code regarding the application of a fair approach in determining the rationality and efficiency of land use, after signing, will come into force at the beginning of 2024.
