Administrative liability for violations in the sphere of advertising

The deputies adopted amendments and additions to the Code of the Pridnestrovian Moldavian Republic on Administrative Offenses in the second final reading in the course of the plenary session. The new rules affect administrative liability for violations in the field of advertising. The author of the legislative initiative is the Government of the Pridnestrovian Moldavian Republic.

The law-in-draft provides for the expansion and clarification of offenses in the field of advertising. An administrative fine will be imposed for the installation of an advertising structure without permission and without a technical passport in violation of the installation and operation rules now. Advertisers, advertising producers or advertising distributors will be forced to pay an administrative fine for placing an advertisement that violates the requirements for its content, time, place and method of distribution in addition. Administrative liability will also be provided for unfair comparison of your product with the products of competitors. Changes are made in order to bring normative legal acts in line with current legislation.

The changes adopted at the plenary session delineated the powers of state bodies in the field of advertising. The Ministry of Digital Development will be responsible for violations related to the content of advertising now. For example, the presence of false or unethical information as well as the rejection of counter-advertising. Administrative commissions under state administrations will consider offenses related to the installation of an advertising structure without permission, as well as the destruction or damage of posters. The advertising containing unfair comparisons with competitors' products will be dealt with by the antimonopoly authority.
