Government bodies, enterprises and organizations were forced to switch to remote operation last year, due to the coronavirus pandemic and the action of restrictive measures. Now the average daily incidence of COVID-19 has decreased in the republic, but the virus has not yet been defeated. Wear protective masks in public and maintain social distance. The epidemiological situation requires amendments to the legislation related to the electronic exchange of documents. The PMR President Vadim Krasnoselsky introduced law-in-draft for consideration by the Supreme Council, the adoption of which will allow issuing executive documents in electronic form. Moreover, it must be signed with an enhanced qualified electronic signature.
Changes need to be made to the Criminal Procedure Code, the Civil Procedure Code, the Arbitration Procedure Code, the Code of Administrative Offenses and the Law on Enforcement Proceedings. The relevant law-in-draft was considered by the Legislation Committee today.
The court decides how to issue a writ of execution for debt collection - in electronic or paper form. The judicial authority can use a remote method of transferring documents, if it is technically possible.
Requirements for the formats of writs of execution, court orders issued in the form of electronic documents will be approved by the PMR Government.
The law-in-draft was recommended for adoption in the first reading at the plenary session of the Supreme Council.
