The Government proposed to improve the institution of administrative supervision over persons released from prison. Changes and additions are being made to the relevant law “On administrative supervision of internal affairs bodies over persons released from places of imprisonment”. The law-in-draft was considered in the course of the meeting by the Committee on Legislation, Protection of Rights and Freedoms of Citizens.

For example, it is proposed for the sake of efficiency to entrust the Ministry of Internal Affairs with resolving issues regarding the suspension and renewal of administrative supervision. The deadlines for notifying the internal affairs body about a change of residence are adjusted for supervised persons. This will have to be done in advance – no later than 3 working days, and you can notify within 3 working days after changing your place of residence in emergency situations. In addition, the list of circumstances when the Ministry of Internal Affairs may allow a supervised person to travel outside the republic is being expanded, for example, not only due to the need to undergo treatment, training, or due to the death or serious illness of a close relative. It will be possible, with the permission of the internal affairs body, to leave for work, moreover within the territory established by the court.

Another law-in-draft, considered by the Committee deputies and proposed by the Government, introduces changes and additions to the Code of Administrative Offences. It is proposed to supplement the Code of Administrative Offenses with a new article 14.46, which prescribes liability for violations of the rules for the circulation of scrap ferrous and non-ferrous metals. The State Supervision Service of the Ministry of Justice will draw up protocols on administrative violations in relation to officials of organizations that have violated such rules.

These two legislations will be considered at the next plenary meeting in the first reading. Deputies of the Legislation Committee considered a number of other relevant issues, one of which was the law-in-draft “On advocacy and the legal profession in the Pridnestrovian Moldavian Republic”. The document has been prepared for adoption in the third reading. The Criminal Procedure Code, the Civil Procedure Code and the Code of Administrative Offenses are being adjusted to apply the new law.
