Deputies of the Committee on Education, Public Associations and the Media Igor Buga and Pavel Shinkaryuk have prepared amendments to the Housing Code of the PMR in order to clarify the standard for providing residential space (clause 2 of Article 72 of the Housing Code). The law-in-draft will be submitted to the Supreme Council for consideration in the near future.
According to the law, the standard for providing residential space under a social tenancy agreement is at least 18 square meters of total housing space per member of a family of three or more people, 42 square meters for a family of two, 33 square meters for a single citizen. The deputies want to supplement the digital values of this standard with the words "at least". This will lead to a uniform understanding of the norm of the law, the authors emphasize, and the local executors will understand the rules for implementing the norm in practice: it is possible to provide space under a social rental agreement if it is not less than the specified square footage.
The reason for the development of the law-in-draft by the deputies were the problems that arose during the implementation of the state program for the acquisition of housing for orphans. There were cases in practice when local executors could not buy housing for orphans at the expense of the state, since its square footage exceeded the square footage specified by the norm of the Housing Code. The plan of the State Target Program for 2024 in the republic has not been fully implemented in fact. The Education Committee held an online meeting on its site in order to clarify all the problematic aspects associated with the failure to implement the state program for the acquisition of housing for orphans on time. Deputies of the Supreme Council, representatives of state administrations and the Ministry of Social Protection and Labor took part in the discussion. The initiator of the meeting was the Deputy Chairman of the Committee on Education, Public Associations and Mass Media Pavel Shinkaryuk, representing the interests of the residents of Slobodzeya (District No. 21).
As noted by the Chairman of the Committee on Education, Public Associations and Mass Media Igor Buga, the result of the meeting with the participation of representatives of the executive branch of government should be specific developments on adjusting the current mechanism for implementing the state program.
It was noted in the course of the meeting that this year the plan for the State Target Program was not fulfilled the most in Rybnitsa District and Rybnitsa – 47% of the allocated funds were not spent. The Supreme Council voted at the plenary session on October 30to redirect to other state administrations the unspent limits of the Rybnitsa State Administration for the purchase of housing for orphans.
This year's plan for the GTP has not been spent by 25.5% in Slobodzeya District. Only 10 out of 17 residential premises have been purchased so far. Local authorities have encountered a number of problems in practice.
The need to clarify the current norm on the square footage of housing was noted during the meeting. That is why the deputies of the Education Committee Igor Buga and Pavel Shinkaryuk initiated law-in-draft to amend the Housing Code. The document is currently being studied in parliamentary committees. The Supreme Council will consider the initiative at a plenary session In the near future.
The participants in the discussion voiced other problems during the discussion of the implementation of the state program for the purchase of housing for orphans. They concern not only the square footage of housing, but also the determination of its market value. The price at which it is planned to buy housing for an orphan should not exceed the amount specified in the act of concluding the market appraisal in fact. This is specified in Government Resolution No. 97, the participants in the meeting noted.
A representative of the State Administration of Rybnitsa explained that the cost of housing in Rybnitsa has now increased significantly, apartments have risen in price. The seller wants to receive an amount greater. In particular, local authorities were unable to purchase a number of residential premises for this reason. The Supreme Council deputies consider that the market value of housing should not be an obstacle to purchasing residential premises for orphans. The parliamentarians emphasized that the main goal of the program is to purchase the planned number of residential premises within the established funding limits and provide orphans on the waiting list with housing.
The meeting participants talked about the terms of the contracts, whether it is possible to extend them until the end of the year, since now, according to the rules, contracts can be concluded until December 1. Representatives of state administrations asked whether an orphan can apply for housing if his or her spouse owns a residential premises and whether it is possible, to provide him or her with an apartment whose area is smaller than that provided for by law with the consent of the orphan.
Each issue that arises in practice requires detailed study, they said at the meeting. The Chairman of the Committee Igor Buga suggested that representatives of the executive branch of government and deputies of the Supreme Council take the initiative to resolve issues that arise in practice on the implementation of legislation in the sphere of implementing this social state program.
