Among the three branches of government of the legal state the judiciary is at special position due to the fact that it is an arbitrator in legal relations. Decision of the court entered into force as well as the norms of the law, is necessary for the parties involved and subject to strict execution. Despite this, the topic of default entered into force verdicts, judgments and other judicial acts become all the more urgent. In many states the citizens for such violations are punishable by a fine or prosecuted. For example, in neighboring Moldova, the willful failure to perform the verdict criminal liability to imprisonment for a term up to two years, in Ukraine and in the Republic of Kazakhstan - up to three years.

Pridnestrovian Criminal Code states about the prosecution of government officials, civil servants, and employees of local governments, as well as state and municipal institutions, commercial or other organization. In order to extend criminal penalties on all those responsible, regardless of status and belonging to one or another branch of power or position, member of parliament Galina Antyufeeva proposed to supplement the Article 311 of the Criminal Code of PMR. As explained by the author, any law may undergo changes dictated by time; often there is a necessity to address gaps in the current legislation. Life examples reveal problems requiring legislative intervention.

The introduction of criminal responsibility for any and all persons who willfully evading enforcement of the judgment, will also be as a measure of a preventive nature for all the debtors of the executive documents and encourage them to repay the debt, according to the relevant committee.
