The law-in-draft of the Prosecutor of the Pridnestrovian Moldavian Republic was considered by the Committee on Legislation, Protection of the Rights and Freedoms of Citizens deputies in the course of their meeting. Anatoly Guretsky proposes to introduce criminal liability for the transfer of control of a vehicle to a person who does not have the right to drive it, if this caused serious harm to human health or death. The terms of imprisonment, depending on the severity of the consequences, are proposed to be up to 2 years, 5 years or 7 years. The Prosecutor also initiated in this regard the law-in-draft to improve the norms of the Code of Administrative Offenses. The law has already an article for driving a car without a driver's license, for which a fine is provided – 50 minimum wages (920 rubles). Such administrative responsibility according to the Prosecutor should be applied only in cases where the offense did not lead to serious consequences: “if the actions do not contain signs of a criminally punishable act,” the explanatory note to the law-in-draft says.
When considering two initiatives of the Prosecutor, the deputies had questions. For example, it is not clear who will be held liable if another family member is entered in the owner's registration certificate. What is the rationale for the introduction of criminal liability for such a violation, since there are no such norms in Russian legislation. There are similar ones only in the legislation of Kazakhstan.
According to the deputies of the Committee, such offenses as the transfer of control of a car to a person without a driving license should be stopped. They proposed not to introduce criminal liability, but to finalize the administrative code and increase the size of the fine.
By a majority of votes, the deputies of the Committee decided to reject the draft law on the introduction of criminal liability. The law-in-draft on amendments to the Code of Administrative Offenses was supported on the condition that the law-in-draft would be finalized taking into account the comments of the relevant committee. Both initiatives of the PMR Prosecutor will be submitted to one of the plenary sessions
