Amendments to the Land, Civil and Forest Codes

The need to make amendments to the Land and Civil Codes was discussed by parliamentarians of the Committee on Agro-Industrial Complex for a long time. Two alternative legislations were discussed – by Deputy Vadim Levitsky and the Government of the Pridnestrovian Moldavian Republic in the course of the meeting today. The parliamentarian decided to withdraw his law-in-draft after discussion. The Committee proposes to take the Government's initiative as a basis.

This document provides for the optimization of legal mechanisms that will determine the procedure for the forced termination of rights to land plots that are not used for their intended purpose. As well as the procedure for the alienation of an object of construction in progress located on a land plot, the right to which has been terminated. Among other things, the law-in-draft should eliminate the ambiguity in determining the moment when the use of a land plot for construction purposes begins and the moment when the obligation to use the land for the intended purpose is considered fulfilled.

The deputies noted that there are comments and additions to the submitted initiative of the Government. In particular, parliamentarians and representatives of the Ministry of Agriculture and Natural Resources have not yet agreed on how the mechanism to extend the deadlines for some objects should work. Chairman of the Committee on Agro-Industrial Complex Oleg Leontiev considers that public authorities should have such a right. However, this issue will be settled already in the second reading.

Another topical issue is changes to the Forest Code of the Pridnestrovian Moldavian Republic. We are talking about the introduction on the territory of the republic of the institution of compensatory gardening. It is proposed to legislatively establish an obligation to ensure double compensatory landscaping. That is, it will be necessary to plant two instead of one felled tree. The President of the Pridnestrovian Moldavian Republic Vadim Krasnoselsky has repeatedly spoken about this earlier. The requirements of the new law should apply to the entire territory of the republic. It is proposed to make double compensatory landscaping mandatory in settlements, parks, squares, arboretums, botanical gardens, groves, boulevards and agricultural lands. The document will be submitted for discussion at the plenary meeting in the near future.
