Amendments to the Criminal Code and the Code of Administrative Offenses

The deputies of the Committee on Legislation, Protection of the Rights and Freedoms of Citizens at the first meeting in 2023 supported a number of legislative initiatives that will be considered at the next plenary meetings.

One of the items on the agenda was the discussion of law-in-draft that proposes to amend the Code of Administrative Offenses. The authors of the legislative initiative were the deputies of the relevant parliamentary committee - Galina Antyufeeva, Oleg Petrik, Vadim Lipsky and Valery Babchinetsky. The law-in-draft proposes to exclude such type of administrative responsibility as confiscation of objects of an administrative offense for offenses provided for in Article 19.21 of the Code of Administrative Offenses of the PMR. In the event of a violation of the mandatory requirements of state standards, requirements and rules for mandatory certification, an official, an individual entrepreneur, a legal entity, in addition to paying a fine, also falls under the confiscation of objects of an administrative offense (property) at present. The reason for the development of this initiative was the appeals of citizens as explained by the Head of the Committee on Legislation, Protection of the Rights and Freedoms of Citizens, Vice Speaker of the Parliament Galina Antyufeeva. The Profile Committee will recommend the adoption of the law-in-draft at the plenary session in two readings at once.

The deputies in the second reading discussed the law-in-draft on amendments and additions to the Criminal Code. The initiative of the Prosecutor of the Pridnestrovian Moldavian Republic proposes to eliminate the legal gap in the current criminal legislation. The draft law proposes in part three of Article 17 of the Criminal Code of the Pridnestrovian Moldavian Republic to provide for the possibility of recognizing in the actions of a person a particularly dangerous recidivism of crimes, in case that a person commits a serious crime, for which he is sentenced to real imprisonment, if earlier this person was convicted for a serious and especially serious crime to real deprivation of liberty. Deputies of the relevant Committee supported the amendments to the law-in-draft and recommended it for adoption at the plenary session in the second final reading.

The parliamentarians discussed the government's initiative to amend the Law of the PMR "On the State Civil Service of the Pridnestrovian Moldavian Republic". This law-in-draft proposes to consolidate the procedure by which a civil servant will be given the opportunity to fill a position in the event of liquidation of a state body. The civil servant will have to be offered vacancies in other state bodies in the absence of vacancies. The deputies of the Committee on Legislation, Protection of the Rights and Freedoms of Citizens decided to recommend this law-in-draft for adoption in the first reading at the plenary session and continue working on it, taking into account all the comments and suggestions.
