Results of the work of the PMR Arbitration Court for 2022

The position of Chairman of the Arbitration Court may continue to be held by Aleksandr Kiyko for the next 6 years. His term expires in February. The PMR President proposed the candidacy of the current Chairman of the Arbitration Court. According to the law, the Supreme Council must approve. The proposal of the President was supported by deputies in the course of the meeting of the Committee on Legislation. The nominated candidacy of Aleksandr Kiyko meets the constitutional requirements in their opinion. The issue of his appointment will be considered at one of the plenary sessions of the Supreme Council.

The deputies of the Committee considered a report on the results of the work of the Arbitration Court for the past year. 887 lawsuits and other applications were submitted totally for consideration. The indicator decreased by 7.8% compared to 2021. Depending on the nature of the claims (applications) brought, the following are distinguished as the main activities of the Arbitration Court:

• Consideration of cases on disputes arising from civil legal relations;

• Cases initiated at the initiative of public authorities;

• Consideration of cases on disputes arising from administrative and other public relations;

• Consideration of cases on the establishment of facts of legal significance;

• Consideration of insolvency (bankruptcy) cases;

• Consideration of cases on corporate disputes.

The average caseload for judges of first instance was 11 cases per judge per month in 2022. This figure is almost the same as in 2021. The load on the judges of the cassation instance was 7 cases per month, for the previous reporting period there were 5 cases.

According to the profile committee, the Arbitration Court of Pridnestrovie does not fully exercise its right of legislative initiative. The deputies expressed hope for closer cooperation between the court and the Supreme Council to eliminate shortcomings and improve the current legislation.
