The Criminal Legislation Humanization

Pregnant women, mothers of children under 14, and men who are the only parent of children under 14 can receive a deferment of serving a sentence according to Article 81 of the Criminal Code of the Pridnestrovian Moldavian Republic. The court can defer serving the sentence for this category of convicts until the child turns 14. Readjournment does not apply to those sentenced to a term of more than 5 years for serious and especially serious crimes, for crimes against the sexual inviolability of minors, for crimes related to terrorist activity, and for other serious crimes at the same time. The court sentences him according to the totality of the sentences if during the deferment period the convict again violates the law.

The Chairperson of the Committee on Legislation, Protection of Citizens' Rights and Freedoms Galina Antyufeeva and her deputy Grigory Dyachenko proposed to humanize the provisions of the criminal law in this part. The authors consider it necessary to supplement Article 81 of the Criminal Code so that it would be possible to again receive a deferment of serving a sentence for a crime committed during the deferment period due to negligence or an intentional crime of minor or medium gravity. The decision to cancel or maintain a deferment of serving a sentence is made only by the court, the authors of the amendments specify. 

The court must cancel the deferment of serving a sentence and sentence the convicted person to a combination of sentences, if an intentional grave or especially grave crime is committed during the deferment period, according to the law-in-draft. The proposed changes will become an incentive for law-abiding behavior of convicted persons and will help maintain their family ties with their children, as the authors of the law-in-draft note. 

The Committee deputies decided in the course of the meeting to recommend that the deputy corps adopt the law-in-draft in the first reading. If adopted, the relevant committee will continue working on amendments to the Criminal Code in the second reading, taking into account comments and suggestions.
