Completely new for Pridnestrovie law "On state genomic registration in the PMR" will enter into force on January 1, 2022. Today the Supreme Council deputies adopted it in the third final reading. It implies amending a number of regulations that could conflict with the adoption of a new law on genomic registration.
The deputies at the plenary session voted to amend the Criminal Procedure Code, the Law on Personal Data and the Law on the militia:
- amendment was made to the Criminal Procedure Code on the mandatory genomic registration of unidentified corpses;
- to the law "On the militia", along with the state fingerprint registration, the state genomic registration is also referred to the duties and rights of militia;
- in the law "On personal data" the concept of biometric personal data and the basis for their processing without the consent of the subject of personal data has been changed (mandatory state genomic registration).
Thus, the current legislative acts were brought in line with the adopted law regulating the registration of human genomic data at the state level.
It is necessary for the new law to come into effect in the state budget to allocate approximately 1 million 150 thousand rubles a year. It is assumed at the same time that funds will flow to the republican budget through voluntary state genomic registration. According to the calculations given in the explanatory note, the cost of one genotypic study in 2019 was 983.04 rubles.
The law "On state genomic registration" was adopted by the parliament at the end of March 2021 in the second non-final reading. The new law stipulates that only citizens who have been convicted and are serving a sentence for committing grave or especially grave crimes, as well as all categories of crimes against sexual inviolability, will be subject to mandatory genomic registration. The DNA database will definitely include biological material that was taken at the crime scene or during investigative actions and was not identified, and biological material of the deceased, whose identity has not been established. Any Pridnestrovian can voluntarily enter data on his DNA, but this procedure will be paid.
Thus, the genomic database will first of all help forensic scientists and investigative bodies to quickly disclose committed crimes, more effectively search for missing persons and establish the identity of a person.
