Social politics

Law-in-draft, according to which war invalids to enjoy benefits for the installation of metal-ceramic dentures, was adopted. This expensive material was previously excluded from the norms of the law "On Social Protection of War Veterans". The next year's budget includes 250 thousand rubles for the implementation of benefits for war invalids for dental prosthetics. The amount of compensation for each patient in this category will be determined by the Government.

The Labor Code has been amended. The amendments adopted by the deputies prescribe that heads of organizations and specialists are required to undergo labor protection training, as well as to check knowledge of labor protection requirements once every 5 years, and employees once every 3 years. In organizations where high-risk work is not performed and there is no production, managers are trained in labor protection in the form of self-training. Employees of such organizations are instructed on labor protection once a year. Simplified mechanism for training in labor protection when changing jobs. If a specialist was trained, for example, six months ago and moved to the same position in another organization, then there will be no need to undergo training again. The new changes protect the rights of workers of retirement age. If they switch from an indefinite to a fixed-term contract, then they have the right to take unused vacation, as required by law.

 

Healthcare

A simplified mechanism for the import of medicines into the republic will also operate in 2023. The norm allowing the import into the republic of medicines not registered in the countries of the European Union or the CIS is being extended for a year. Amendments to the law "On Pharmaceutical Activities in the PMR" were initiated by a group of deputies on the basis of appeals received from the Association of Pharmacists of Pridnestrovie. Imported drugs must be registered and certified in Pridnestrovie at the same time.

The law "On Procurement in the PMR" will not apply to medicines for the treatment of HIV infection, vaccines and other immunobiological preparations, laboratory testing services for infectious diseases. The law-in-draft was initiated due to the fact that the Republic of Moldova refuses to conclude an agreement with the Ministry of Health of the PMR as a customer. Amendments to the law "On Procurement in the PMR" will allow timely provision of certain categories of citizens with the necessary medicines and the population of Pridnestrovie with vaccines for routine vaccinations.

 

The Housing Code Correction

Amendments in connection with the adjustment of the Housing Code were made to the Civil Code of the Pridnestrovian Moldavian Republic. The changes affected the law “On local authorities, local self-government and state administration in the PMR”. The amendments concern the issue of publishing annexes to legal acts in regional newspapers. If the decisions of local authorities were published on the official website, they must be published in the next issues of the district newspaper without fail. At the same time, annexes to legal acts may not be printed if a link to the official website is published, where the document is posted in full. The decision on the proposal of the City and District Council of Grigoriopol was made due to the limited number of newspaper pages in regional publications and due to the often voluminous annexes to legal acts. The law was adopted in the second final reading.

The law-in-draft on amendments and additions to the Housing Code was adopted in the third final reading. The new amendments protect the rights of children if they lived in public housing under a commercial or social tenancy before the death of a parent or guardian. Now, the consent of the employer will not be needed in order for a minor who has been left without care to be moved in under a social contract of employment by a single parent, guardian or trustee.

 

Agro-industrial complex

An institution of compensatory gardening will appear in Pridnestrovie from the new year: instead of one felled tree, two trees must be planted. Changes were made with the PMR Forest Code. Double compensatory landscaping will be mandatory in settlements, parks, squares, arboretums, botanical gardens, groves, boulevards and agricultural land.

One of the norms of the PMR Law "On Certification of Products and Services" that exempts product manufacturers from additional financial costs has been extended for 2023. If the product manufacturer has a certificate or declaration of conformity from the countries of Europe and the CIS, then it is not necessary to carry out mandatory certification in the PMR. The exception is medical and pharmaceutical products

The fixed agricultural tax will cease to operate in the republic from January 1, 2023. It was introduced back in 2004 and replaced three others – land, for the maintenance of housing stock and a single agricultural one. This preferential tax regime was designed to reduce the tax burden for farmers and encourage entrepreneurs to work in the agricultural sector. The preferential tax regime has fulfilled its functions today, according to the Government. The parliamentarians agreed with this opinion, noting that state support for agricultural producers will continue. It is noted that the income tax rate is one of the lowest in the republic and amounts to 1.3% for organizations in the field of agriculture.

 

Education

The state administrations of cities and districts from January 1 will organize the transportation of children to kindergartens and schools in rural areas and back if the distance from the place of residence to the educational organization is more than 1 km. These powers were previously assigned by law to the state administrations of villages and urban-type settlements. The changes affected the envisaged distance between destinations. The delivery of children to schools and kindergartens until now was carried out in cases where the distance from the place of residence to the organization of education exceeded 3 km.

The deputies specified the procedure for conducting final certification for students with intellectual disabilities who studied according to an adapted basic general education program and passed an exam in labor training in the law "On the Education of Persons with Disabilities (Special Education)". Such graduates will be issued a certificate of study, the sample of which will be established by the Ministry of Education now. The relevant ministry was assigned the right to determine the specifics of the final certification for persons with disabilities.

Full state support for pupils of the Suvorov School and the Cadet Corps is now enshrined in the Law of the PMR "On Education". Accommodation, regular meals, uniforms and medical care are provided to students at the expense of the republican budget for the period of stay in an educational institution. The deputies eliminated a gap in the legislation with this decision. These norms were in force for several years, but were provided only by by-laws of the Government.

 

Changes to the Criminal Code

Tougher criminal liability for drivers, who drive in a state of intoxication, having already been convicted for this offense. Such drivers can be imprisoned for up to 3 years. A 2-year term was prescribed in the Criminal Code previously. The maximum fine has also become larger – not 400, but 500 minimum wages (9200 rubles). Changes to the Criminal Code also affected those who drive a vehicle while deprived of a driver's license and have a criminal record for driving, which led to the death of a person or injury to health. They can be imprisoned for this offense for 2 years or fined up to 600 minimum wages (over 11 thousand rubles). The law signed by the President comes into force on December 29.

The law-in-draft of the PMR Prosecutor on amendments to the Criminal Code was supported. They relate to the article on exemption from criminal liability in connection with reconciliation with the victim. If a person for the first time committed a crime of small or medium gravity without causing harm to health, reconciled with the victim and made amends, then he can be released from criminal liability. The release will also apply to minors who have committed a crime for the first time or repeatedly, while not causing harm to health, reconciled with the victim and compensated for the damage.

 

The Code of Administrative Offenses Correction

The deputies adopted amendments to the Code of Administrative Offenses regarding the introduction of a fine for stopping or parking closer than 1 meter from ramps, entrances or stairs. The ban on stopping is prescribed in the rules of the road. Now administrative responsibility is introduced for violation. The law signed by the President comes into force on December 29. Traffic militia officers will have the right to issue a warning or a fine to the violator in the amount of 10 RU of the minimum wage (184 rubles). Disabled drivers of groups I and II, those who transport disabled people or disabled children, drop passengers, unload luggage can stop near ramps, entrances and stairs.

Amendments to the Code of Administrative Offenses expanded and clarified the composition of offenses in the field of advertising. An administrative fine may be issued for the installation of an advertising structure without a permit and a technical passport. Anyone who gives, produces or distributes advertising will be forced to pay a fine for placing an advertisement that violates the requirements for its content, time, place and method of distribution. Administrative liability will also be provided for unfair comparison of your product with the products of competitors. Changes were made in order to bring normative legal acts in line with current legislation. Powers in the field of advertising are delimited between the Ministry of Digital Development, administrative commissions under state administrations and the antimonopoly authority.

 

Establishment of a military inspectorate

A military inspection has been created in Pridnestrovie. The deputies supported the legislations of the PMR President, they have already entered into force. The new body in the structure of the Armed Forces ensures the protection of the life, health, rights and freedoms of military personnel and maintains law and order in the troops. Similar rules apply in Russian legislation.

 

Rights of convicts

The legislations have been adopted to address many of the issues faced by convicts. Amendments were made to the Penal Code and the Law “On Detention of Suspected and Accused of Committing Crimes”. The suspects and the accused will be allowed visits with a notary and unlimited correspondence with relatives and friends.

The number of parcels (transfers) per year increases for convicts under certain articles. It will be possible to have more money in personal accounts to buy food and essential goods. It will be possible for convicts to travel outside the penitentiary institutions for a short time in the prescribed manner, under escort and under exceptional life circumstances, for example, to bury a close relative or to meet with a disabled child. There are exceptions according to the categories and characteristics of convicts, according to the regime of detention.

The opportunity for convicts to receive secondary specialized or higher education, including in absentia, is prescribed.
