The State Supervision Service will be able to file a lawsuit in court to forcefully return an unauthorizedly converted premises to their previous state

The State Supervision Service of the Ministry of Justice is granted the right to file a lawsuit in court to forcefully return an unauthorizedly converted premises to their previous state if the inspection reveals violations. The deputies adopted the relevant amendments to the Housing Code of the Pridnestrovian Moldavian Republic at the plenary session of the Supreme Council in the second final reading.

Amendments were prepared for the second reading. Thus, the Committee on Regional Policy, Local Government and Housing and Public Utilities clarified the list of persons who are held liable in the event of their conversion of residential premises without the appropriate permission of the authorized body. The author of the law-in-draft, the Government, proposed to include only the owner and tenant of the residential premises among such persons, while unauthorized reconstruction of the residential premises is also possible for the tenant. The amendment supplements the list of responsible persons with such a subject as the tenant in this regard.

Another amendment of the parliamentary committee retained the right of state administrations to make a decision on returning the unauthorized reconstruction of the premises to their previous state. While the original version of the law-in-draft was about transferring these powers from state administrations to the State Supervision Service of the Pridnestrovian Moldavian Republic. Thus, both the State Supervision Service and state administrations will be able to issue orders to eliminate violations and go to court after the law comes into force.

A period must be set for returning the unauthorized reconstruction of the premises to their previous state at the same time. Taking into account the nature of the changes, it can be from 1 to 6 months. If the violation is not corrected within this time, the authorized body or the State Supervision Service are required to apply to the court within 10 working days with a claim for the forced return of the unauthorizedly reconstructed premises to their previous condition.

The law delineates the powers of the executive bodies of state power to regulate housing relations and ensure the safety, proper maintenance and use of the housing stock. Thus, the Ministry of Economic Development will be responsible for the development of state policy and regulatory regulation in the sphere of housing legal relations. Maintenance and safety of state housing stock facilities for ensuring the proper use – those executive bodies of power in whose jurisdiction these facilities are located.

The deputies adopted amendments to the Housing Code of the PMR unanimously. The law was sent to the President for signing and publication.
