Self-employed Russians can get out of the work of the Labor Code

27.08.2018

Legislative parallels are traced in many provisions of the legislation of Pridnestrovie, since 2006, which has taken the course to harmonize with the legal framework of Russia.

The activities of nannies, tutors and nurses will be removed from the norms of the Labor Code of the Russian Federation in Russia, and their work will be regulated by a separate law.

The law-in-draft is at the stage of public discussion and is being evaluated by experts. Several agencies have been connected to the joint work on the preparation of the regulatory regulation of the self-employed. So, the Ministry of Justice is preparing a separate law that will determine the status of such employees, and the Ministry of Finance is developing proposals to simplify registration and possible tax benefits.

Now the self-employed, in particular tutors, nannies and nurses, are subject to the Labor Code, "however, as a rule, the above activities are carried out without appropriate registration of the relationship" and there is no control over compliance with labor laws. This is due to the fact that the employer can not actually act as an employer - to enter into and register an employment contract, pay insurance contributions for an employee, make out an insurance certificate of pension insurance, etc. Therefore, the existing scheme is proposed to be changed.

Russians will be given a personal credit rating. In 2019 amendments to the federal law "On Credit Histories" will come into force, thanks to which it will be easier for banks to decide whether to give money to a person or not, and citizens can better understand how they look in the eyes of creditors.

The borrower's rating will be calculated automatically, based on the existence of delinquencies, the level of the debt burden, the number of requests for checking the credit history and its "age." The higher the score, the lower the risk. In fact, the rating calculation is a system used by banks to assess customers, on the basis of which the creditors decide on the issue of a loan. However, unlike the confusing credit history, often incomprehensible to consumers of banking services, a personal rating is promised to make it accessible for understanding.

A personal credit rating will be of interest to microfinance and insurance organizations.

The innovation will contribute to the disclosure of fraud. A person with large debts can illegally use their insurance - for example, staged a theft or an accident to recover compensation from insurance company. The rating will be useful when hiring for materially responsible or leadership positions.
