The PMR Prosecutor will be able to initiate and investigate cases of crimes against state power, against the interests of the state and municipal service, as well as crimes committed by officials. The Supreme Council gave additional powers to the PMR Prosecutor by supporting the draft laws submitted by Anatoly Guretsky in the second final reading. The Prosecutor's Office had the authority to investigate criminal cases until 2012, when the Investigative Committee had not yet been formed in the republic.
The amendments to 3 laws were adopted taking into account the amendments prepared by the relevant Committee on Legislation, Protection of Rights and Freedoms of Citizens. For example, only the Prosecutor of the Republic, and not his deputy, will have the right to order the verification of a statement or report of a crime, as well as to order a preliminary investigation. Cases of official crimes will be handled by senior investigators of the Prosecutor's Office, their number should not exceed 3 full-time positions. In addition, the Prosecutor has the right to request a criminal case from the Investigative Committee if necessary.
During the discussion of the law-in-draft, the Supreme Council deputy Porfiry Shkilnyuk inquired whether the Prosecutor's Office is vested with the functions of investigation, prosecution and supervision in any countries. Prosecutor of the Pridnestrovian Moldavian Republic Anatoly Guretsky explained that such a system operates in almost the entire post-Soviet space.
Explanations of the prosecutor's legislations were given by the vice-speaker of parliament, chairperson of the Committee on Legislation, Protection of Rights and Freedoms of Citizens Galina Antyufeeva. She emphasized that the initiatives were discussed at length in parliament and the new powers are designed to solve problems that arise in practice. The prosecutor's legislations were supported by the Supreme Council in the second final reading by a majority of votes. Changes were made to the Constitutional Law of the PMR "On the Prosecutor's Office of the Pridnestrovian Moldavian Republic", to the Criminal Procedure Code of the PMR and to the law "On the Investigative Committee of the Pridnestrovian Moldavian Republic". The legislations will enter into force 14 days after the day of official publication.
