The legislations on amendments to the Code of Administrative Offenses of the Pridnestrovian Moldavian Republic were adopted at the plenary session of the Supreme Council in the final reading.
Drivers with phones in their hands will be identified by video surveillance cameras
The Supreme Council considered in the final reading the initiative of the President of the Pridnestrovian Moldavian Republic on liability for drivers with phones in their hands. After the law comes into force, law enforcement officers will be able to identify such drivers by cameras of the "Safe City" system and bring them to justice. It was decided at the same time to leave fines at the same level, and they will only bring to justice for using phones while driving.
The Law of the Pridnestrovian Moldavian Republic "On Amendments to the Code of the Pridnestrovian Moldavian Republic on Administrative Offenses" will enter into force 14 days after its official publication.
Amendments to the Code of Administrative Offenses proposed by the President and deputies have been adopted
Deputies have adopted amendments to the Code of Administrative Offenses of the Pridnestrovian Moldavian Republic in the final reading, according to which a driver who has caused an accident will be held liable only under Article 12.25 of the Code. The driver is currently held administratively liable twice if the Traffic Rules are violated and there are victims or significant damage to transport or other property: both for violating the Traffic Rules and for causing harm to health or property damage. The adopted initiative of deputies Galina Antyufeeva, Gregory Dyachenko and Oleg Petrik will allow observing the principle of fairness in sentencing for administrative offenses in the field of road traffic. The authors emphasize that repeated prosecution of a person for the same violation is unacceptable in a state governed by the rule of law. The deputies also adopted in the final reading the initiative of the President of the Pridnestrovian Moldavian Republic, related to the same article of the Code of Administrative Offenses – 12.25. Earlier this article determines the amount of the fine for violation of traffic rules or rules for the operation of vehicles by drivers, resulting in damage to transport or other property or causing minor or moderate harm to the health of the victim.
The President of the Pridnestrovian Moldavian Republic proposed to legislatively differentiate between property damage and harm to health resulting from an accident. Thus, such a qualifying feature for determining a traffic accident as "violation by drivers of vehicles of the Traffic Rules or the rules for operating a vehicle, which resulted in significant damage to vehicles, cargo, roads, road and other structures or other property" is excluded from Article 12.25 of the Code of Administrative Offenses. This means that now, in the absence of harm to the health of the victim, the driver who committed such an accident will be held administratively liable not for the fact of committing an accident, but for violating the Traffic Rules. Thus, the culprit incurs administrative liability for the actions that resulted in the accident after an accident, as well as civil liability for the harm caused to the injured party. If the guilty person in the accident has an third party liability insurance policy, the insurer assumes the obligation to compensate for the damage. If the property damage does not fall under the concept of "insured event" or the civil liability of the person responsible for the damage is not insured, the person at fault in the accident is obliged to compensate the injured party for the damage in full in accordance with Article 1099 of the Civil Code of the Pridnestrovian Moldavian Republic. The parliamentary Committee on Legislation prepared amendments that are aimed at increasing liability for causing harm to the health of the victim of mild or moderate severity for the second reading. Thus, the fine increases from 50 to 60 minimum wages (or deprivation of the right to drive a vehicle for a period of 6 months to 1 year) for violating the Rules that resulted in harm to health of mild severity. The fine increases from 100 to 120 minimum wages (or deprivation of the right to drive for a period of 1 year to 1 year and 6 months)for causing harm to health of moderate severity. If the Rules are violated by a pedestrian or a passenger and this creates obstacles to the movement of the vehicle, the administrative fine increases from 10 to 15 minimum wages. And if due to these actions there is a victim in a condition of mild or moderate severity, then the pedestrian or passenger will be fined in the amount of 30 minimum wages (instead of 20 minimum wages – according to the version of the Code before the revision). 1 minimum wage makes 18 rubles 40 kopecks. The law comes into force on the day of signing by the President of the Pridnestrovian Moldavian Republic.
