The grounds for termination and resumption of pension payments are prescribed in the law

03.04.2024

The law "On State Pension provision of Citizens in the Pridnestrovian Moldavian Republic" prescribed criteria for termination and resumption of pension payments. The relevant law-in-draft, developed by the Government of the Pridnestrovian Moldavian Republic, was supported by the deputies in the second final reading in the course of the plenary session.

The law establishes that the termination of pension payment will be made in the event of the death of a pensioner, the appointment of a pension under the legislation of another state, the appointment of a pension in accordance with the procedure established by other legislative acts of the Pridnestrovian Moldavian Republic for certain categories of persons, or in the event of the fact that the pensioner provides false information that is necessary to determine whether he has the right to a pension. The basis for termination of pension payments will be the occurrence of circumstances entailing the loss of the pensioner's right to the assigned pension:

– removal from registration at the place of residence in connection with the departure from the Pridnestrovian Moldavian Republic of a foreign citizen permanently residing in the republic or a stateless person;

– the expiration of the period for which the disability is established;

– acquisition of working capacity by persons receiving a survivor's pension. We are talking about the children, brothers, sisters and grandchildren of the deceased breadwinner who have reached the age of 18, or 23 years old if they studied full-time in educational institutions;

– employment of persons receiving a survivor's pension, namely one of the parents, spouse, grandfather or grandmother of the deceased breadwinner, regardless of age and ability to work, as well as the brother, sister or child of the deceased breadwinner who have reached the age of 18 and are not engaged in caring for children, brothers, sisters and grandchildren of the deceased breadwinner under 14 years;

– reaching retirement age by recipients of a superannuation pension;

– transition from one type of pension to another;

– refusal of a pensioner to receive an assigned pension.

They will be able to resume payment of pensions in case of cancellation of a court decision that recognized the pensioner as dead or missing, in case of resumption of disability, or if the pensioner has applied to resume payment of a pension after refusing to receive it.

The law-in-draft clarifies that the payment of pensions of the Pridnestrovian Moldavian Republic to foreign citizens and stateless persons is made on the basis of identity documents, as well as documents confirming the right to permanent residence in the territory of the Pridnestrovian Moldavian Republic and containing information about registration at the place of residence for at least 1 year. The government version of the law-in-draft provided for similar requirements for the citizens of the Pridnestrovian Moldavian Republic. However, by the second reading, Deputy of the Supreme Council Galina Antyufeeva introduced an amendment according to which citizens of the Pridnestrovian Moldavian Republic can receive pensions regardless of the period of registration at the place of stay.

The new measures will come into force after being signed by the head of state and officially published.
