On the principles and procedure for public procurement

The President Vadim Krasnoselsky signed the law, according to which changes were made to the republican budget for this year. This is due to the entry into force of the new law for the republic “On Procurement in Pridnestrovian Moldavian Republic”. Its provisions are aimed at implementing the basic principles of the public procurement procedure: increasing openness, transparency and the effectiveness of their implementation.

For 2019, the law “On Procurement in Pridnestrovian Moldavian Republic” was suspended with the exception of the rules governing the formation of procurement plans by state (municipal) customers in the process of drafting and reviewing the draft republican (local) budget for 2020.

It was established that in 2019 the conclusion of contracts for the procurement of goods, the execution of works, the provision of services at the expense of the budgets of various levels for an amount exceeding 200 thousand rubles, is not carried out without a tender. This also applies to the repair of roads. Works on emergency response, on the winter maintenance of public roads and their constituent parts, which are in state and municipal ownership, are carried out without a tender.

This year, when purchasing goods financed from budgets of various levels, preference is given to domestic producers, if all economic entities offered equal conditions for the supply and payment of goods (works, services) and the price of goods (works, services) offered domestic producer, higher than that offered by other economic entities, not more than 10%.

From July 1, 2019, the law “On Procurement in Pridnestrovie” as an experiment will be extended to the following state (municipal), commercial customers: the government, the Ministry of Economic Development; State Administration of Tiraspol and Dnestrovsk, State Enterprise “Pridnestrovian Railway”, State Unitary Enterprise “Dubossary HPP” and MUE “Benderyteploenergo”.

The President signed the law on amendments and addendum to the Civil Code. They stipulate that it is held in the form of an auction, a tender or in another form provided for by the legislative acts of the PMR.

The winner of the auction is a person who offered the highest price or the lowest price in cases stipulated by the legislative acts of the republic, and the tender winner is a person who, according to the conclusion of the competition commission, appointed in advance by the bidding organizer, offered the best conditions.
