Deputy corps continues to work on a package of initiatives, regulating immunity. Different opinions were sounded during the plenary session. Oleg Petrik - a representative of parliamentary group who initiated amendments to the Constitution and the laws on the status of deputies - noted that initially it was about the exclusion of immunity Institute. Since we are talking not only about the deputies, but also the President and the judicial community, it was decided to bring current legislation in line with position of the Constitutional Court.
The authors of the legislations insist on the need to enshrine in legislation, including the constitutional level that the deputy of the Supreme Council cannot be brought to responsibility for the opinions expressed by them or received in the course of the parliamentary activities. He is prosecuted for the offense on a common basis. The right to initiate an administrative case is given to the Prosecutor, the criminal - the Chairman of the Investigative Committee. Government representatives asked whether the initiative does not expand the scope of parliamentary immunity. Deputy response was unequivocal: no. The purpose of the changes - is to enshrine a clear mechanism of action of the inviolability of the institute at legislative level.
The official representative of the President Vladimir Bodnar informed the plenary that the conclusion of the President on the initiative, but there is a presidential-parliamentary correspondence, from which we can conclude that the head of the republic is not against the revision of existing rules, but he does not agree with the deputy approach to amend the Basic law of the state.
Having heard enough convincing arguments of parliamentarians, the public prosecutor appealed to the deputies with a request: in case of rejection of his initiative not to adopt the parliamentary, which fully corresponds to the spirit of the whole package of deputy immunity laws. The reason for this treatment is that it is likely to discredit the prosecutors on the ground, said Alexander Deli.
The Chairman of the Legislation Committee Vice Speaker Galina Antyufeeva encouraged to listen to the opinion of the Prosecutor of the Republic, to withdraw two initiatives and to the local councils to maintain the current legislative mechanism. Peter Pasat proposed another proposal: to hold off on making a final decision and in addition, in working order, to study this issue. Both legislations were postponed to the next plenary meeting.
