The Committee on Legislation: Work in the Autumn Session

Improving road safety, document processing convenience, the right to judicial protection – these and other issues were reflected in the legislations that the deputies of the Committee on Legislation, Protection of Citizens' Rights and Freedoms worked on and that were adopted as laws. The preliminary results of the Committee's work in the autumn session are in the material of the press service of the Supreme Council.

 

Road Safety

Deputies of the Committee on Legislation, Protection of Citizens' Rights and Freedoms worked during the autumn session on the President's law-in-draft on improving road safety. The PMR President Vadim Krasnoselsky proposed confiscating cars from malicious offenders in case of violation in order to combat driving while intoxication. The deputy corps agreed with the opinion of the President. Changes have been made to the Criminal Code of the Pridnestrovian Moldavian Republic. An additional penalty in the form of confiscation of a car in addition to a fine or imprisonment will apply to those who were previously brought to administrative or criminal liability for drunk driving and got behind the wheel again while drunk without drawing conclusions. The car that is owned by the convicted person and which he used to commit the crime is subject to confiscation.

About 100 accidents in the republic occur due to the fault of drunk drivers every year. Thus, confiscation of the car will help to protect other road users in the future.

In addition, the Committee on Legislation, Protection of Rights and Freedoms of Citizens worked on amendments to the Code of Administrative Offenses. A fine of 150 minimum wages (2760 rubles) has been introduced for electric scooters, hoverboards, segways and other personal mobility devices driving while intoxication.

Electric scooter riders, like drivers, will now be sent by traffic militia officers for a medical examination or to use a breathalyzer on the spot. Refusal to undergo a medical examination will result in a fine of the same amount as for drunk driving on personal mobility devices – 150 minimum wages (2760 rubles). The amendments and additions to the Code of Administrative Offenses will come into force 14 days after being signed by the President and officially published.

Rules for minibus drivers

Minibus drivers and taxi drivers  are prohibited by law from stopping where there is a "No Stopping" sign. It is possible at the request of passengers in other sections of the road, including at stations, if it is safe. The provisions of the Law "On Road Safety" have been changed, since stopping "anywhere" creates problems for other cars, and accidents are not uncommon. Minibus drivers like all drivers will pay a fine of 10 minimum wages (184 rubles) for stopping under a prohibitory sign. Minibuses must have a video recorder in addition. One must pay for the fare upon entering, otherwise the driver may receive a warning or a fine of 15 to 30 minimum wages (from 276 to 552 rubles) for failure to comply with the transportation rules. Administrative liability is prescribed in the Code of Administrative Offenses. The rule of paying for the fare upon entering was prescribed only by the Government Resolution previously. Few people followed this rule. Therefore, the ban was written into law with the possibility of paying a fine in case of violation of the norm for the safety of the passengers.

 

Punishment for involving children and adolescents in committing a crime has been differentiated

Criminal liability for involving children and adolescents in committing a crime will now be differentiated depending on the severity and number of crimes. Changes to the Criminal Code were made at the initiative of deputies of the Legislation Committee Galina Antyufeeva, Valery Babchinetsky and Gregory Dyachenko. Criminal liability for involving persons under 14 years of age in committing crimes was also separately prescribed. Deprivation of the right to hold certain positions or engage in certain activities for up to 3 years has been added to the prison term as a punishment. The fact of using the Internet will be taken into account when sentencing for involving a minor in committing antisocial acts.

The law will come into force 14 days after its official publication.

 

The "transnistria" is prohibited

The "transnistria" term is prohibited, since this term is associated with the period of the Romanian-fascist occupation and the Holocaust and is equivalent to a manifestation of Nazism. The local population, including the Jewish population, was persecuted during the occupation. Therefore, the use of this term is perceived as disrespect for the victims of those events. Changes were made to the laws "On Combating Extremist Activity", "On Perpetuating the Victory of the Soviet People in the Great Patriotic War of 1941-1945" and the Code of Administrative Offenses. If the term "transnistria" is used in a public speech, in a publicly displayed work or in the media, it will be equated to a manifestation of Nazism, for which administrative liability will be imposed. For citizens, a fine of 10 to 20 minimum wages (from 184 to 368 rubles) or administrative arrest for up to 15 days is prescribed. For officials - from 10 to 40 minimum wages (from 184 to 736 rubles), for legal entities - from 100 to 500 minimum wages (from 1840 to 9200 rubles). Administrative liability will not occur if the term "transnistria" is used to form a negative attitude towards the ideology of Nazism and extremism.

 

For registration of a passport – to the village administration

Residents of villages and towns can contact the local administration if they need to issue, receive or replace a Pridnestrovian passport, as well as to register at the place of residence or place of stay or to be removed from the register since January 1. The deputies adopted the relevant legislations of the President of the PMR Vadim Krasnoselsky on the amendment of the laws "On local authorities, local self-government and state administration in the Pridnestrovian Moldavian Republic" and "On migration registration of foreign citizens and stateless persons in the Pridnestrovian Moldavian Republic". Villagers had to go with documents to the city passport department and the migration registration agency before the amendments to the legislation.

 

Documents can be submitted on the basis of a power of attorney

Documents for registration at the place of residence or at the place of stay, or for deregistration, can now be submitted on the basis of a power of attorney. This option was prescribed for those who cannot submit documents on their own due to a serious illness or age. Amendments to the law "On the right of citizens of the PMR to freedom of movement, choice of place of stay and residence within the Pridnestrovian Moldavian Republic" were adopted at the suggestion of the deputies of the Legislation Committee.

 

The right to judicial protection without paying a state fee

Persons who do not agree with the decisions are exempt from paying a state fee for applying to the court:

- on sending them to a medical-labor sanatorium;

- on extending the period of stay in a medical-labor sanatorium;

- on involuntary hospitalization in a psychiatric institution or on extending the period of hospitalization;

- on involuntary psychiatric examination;

– on compulsory hospitalization in medical anti-tuberculosis organizations for mandatory examination and treatment.

Deputies of the Supreme Council adopted the law-in-draft Supreme Court. Amendments to the law "On state duty" came into force on January 1.

 

Deferment for all doctors

All doctors working in state and municipal institutions now receive a deferment from conscription for military service. These include healthcare organizations, and the penal system, and internal affairs agencies, and the Armed Forces. Amendments to the law "On universal military duty and military service" were adopted due to a shortage of doctors.

 

Rules for debt collection

Collection under enforcement documents is prohibited if the debtor's income is less than the subsistence minimum after deductions. This rule was spelled out in the law "On enforcement proceedings". It was clarified that if a person has non-working citizens dependent on him, it will be necessary to take into account the subsistence minimum for each. Collection on incomes, the amount of which after deductions is less than the subsistence minimum, is not allowed.

 

Electronic database of enforcement documents

The Legislation Committee worked on law-in-draft aimed at providing access to data on enforcement proceedings. It was supposed for this purpose to create an electronic database on the website of the State Service of Bailiffs of the PMR, containing information on enforcement documents. Amendments to the law "On enforcement proceedings" established the peculiarity of proceedings in complex cases and cases with a large volume of enforcement proceedings by a group of bailiffs.

 

Electronic document management

Government and administrative bodies, government agencies and organizations, as well as their territorial and structural divisions, are given the opportunity to send court notices through the Interdepartmental Electronic Document Management. This norm was supplemented by the PMR Arbitration Procedural Code at the suggestion of the Arbitration Court.
