Parliamentarians adopted in the second final reading in the course of the plenary meeting the amendments and additions to the law “On Procurement.
The Ministry of Finance was responsible for maintaining a register of contracts until now (the law has been suspended until December 31, 2024). A procurement register will appear with the introduction of amendments and additions to the law, to which all customers will be required to send complete data on all purchases they conduct, as well as place copies of contracts in the information system.
The law-in-draft proposes to include the entire volume of procurement in the procurement register of state and municipal customers within the framework of maintaining the “register of procurement of state (municipal) customers” maintained by the Ministry of Finance. This register will include information on all purchases without exception, including small purchases, purchases with a single supplier, purchases that constitute state secrets, which today are not subject to referral to the Ministry of Finance under the current law. Access to it will be open only to the Ministry of Finance of the Pridnestrovian Moldavian Republic.
Copies of contracts, with the exception of small purchases, purchases from a single supplier and purchases constituting a state secret, will have to be posted in this case in the information system within three working days following the day the contracts are concluded. This information will be available to everyone. The Government, the author of the law-in-draft noted, that difficulties should not arise, since currently 149 main managers of budget funds are connected to the automated information system of the Ministry of Finance. Users could voluntarily place information on purchases and other monetary obligations in the system until now.
All information on the volume of purchases by state and municipal customers will be available for assessing a particular contract for compliance or non-compliance with the approved funding limits after the adopted changes come into force. This norm will become mandatory.
The relevant Committee on Economic Policy, Budget and Finance agreed with the proposed initiative. Deputies consider that the adopted changes will make all state and municipal procurement more transparent and will be available for monitoring the correct expenditure of budget funds, in accordance with the allocated limits. This mechanism will make it possible to objectively assess the compliance or non-compliance of the volume of purchases with the approved financing limits.
