Humanization of criminal legislation: deferment rules

Convicts who have children will be able to count on another deferment during the period of deferment of punishment if they break the law again, but only in the case of committing a minor or moderate crime or through negligence. The corresponding law-in-draft was adopted in the second final reading in the course of the plenary session. The authors are deputies of the Committee on Legislation, Law Enforcement Agencies, Defense, Security, Peacekeeping, Protection of Citizens' Rights and Freedoms Galina Antyufeeva and Gregory Dyachenko.

The purpose of the innovation is to humanize the criminal legislation of the Pridnestrovian Moldavian Republic. According to the authors, this measure will create additional conditions for preserving family ties for convicts with children under 14 years of age. A deferment of sentence for a pregnant woman, a woman with a child under 14 years of age, or a man who is the only parent is an incentive institution of criminal law, the application of which helps ensure the observance of the rights and legitimate interests of minors, their care and upbringing in a family environment, the authors of the initiative note.

An amendment was adopted for the second reading, which clarifies: the court may release the convict from serving the sentence or the remaining term with the removal of the conviction, or replace it with a more lenient type of punishment not only if the child has reached 14 years of age, but also in the event of his death.

At the same time, it will not be preserved if a person commits a serious or especially serious crime during the deferment period. The convict will be sentenced according to the totality of sentences. The adopted law “On Amendments to the Criminal Code of the Pridnestrovian Moldavian Republic” will enter into force the day after its official publication.
