The autumn session of the VI convocation has ended. The Supreme Council held 12 plenary sessions from September to December, during which approximately 160 legislations were considered. The parliamentary press service has prepared a selection of socially significant laws signed by the PMR President.
State support during the quarantine period
Medical workers sent to "covid" hospitals from the main place of work will receive additional payments for the peculiarities of their professional activities. They are higher than those that specialists now receive as travel allowances, and range from 100 to 1000 MW (from 730 to 7300 rubles), depending on the organization, structural unit, category of workers and position. The amendments to the anti-crisis law were urgently adopted by the Supreme Council.
Those who were eligible for reduced price meals in educational institutions receive food packages before canteens open or before starting offline studies. The amendments to the anti-crisis law adopted by the Supreme Council concern schoolchildren, students of organizations of primary, secondary and higher vocational education, inmates of special correctional organizations, disabled children under 18 years old, attending medical and social preventive institutions and rehabilitation centers. The issuance of food package can be replaced by monetary compensation upon application. Thanks to the amendments, the state provides social support to this category of Pridnestrovians during the quarantine period.
The anti-crisis law has been supplemented with norms that give the right to receive a pension from the moment of reaching the retirement age. The amendments were made for those Pridnestrovians who were unable to send an application to the Unified State Social Insurance Fund during the state of emergency. After the amendments adopted by the Supreme Council, this category of pensioners was recalculated.
Social protection of Pridnestrovians
A special agreement will now be concluded between those who need social services and the organization that provides them - an individual social service program. The document specifies the form of social services, types, volume, frequency, conditions, terms for the provision of social services - depending on the needs of an elderly person or a disabled person. The form and procedure for drawing up an individual program is determined by the relevant department.
The state compensates war invalids for the cost of repairing cars over 7 years old, which was purchased at its own expense and is needed for medical reasons. Amendments to the law "On social protection of war veterans" concern 10 combatants who became disabled after the war. Previously, they were not subject to legal regulations. War invalids - owners of a car that has passed 7 years or more since its release - are entitled to compensation. The amount of payments, taking into account the indicators of the technical condition of the car, is determined on the basis of the document of the service station. The maximum amount of compensation is more than 9 thousand rubles (505 MW).
Share payments for 2019 will be made until December 30 of this year. The Supreme Council extended the deadline by making amendments to the anti-crisis law. Shareholders - employees of collective, state, municipal and other agricultural enterprises have the right to payments.
Civil servants, including participants in the military operations to protect the PMR, who work in government organizations, they now can privatize housing occupied under commercial lease agreement for free. The Supreme Council adopted the relevant amendments to the law "On the privatization of the state (municipal) housing stock". The new norm of the law will apply to those who have been provided with housing under commercial lease agreement, provided that a person has been continuously working in state or municipal authorities for at least 10 years, or if the period of residence in rented commercial housing is at least 10 years.
Disability Laws
Disabled persons of groups I and II can register at the employment center, but without assigning the status of an unemployed. Thus, the state will help them find jobs. The adopted amendments to the legislation make it possible to provide unemployed disabled people with individual assistance in finding employment, to create conditions for work and professional adaptation. To register at an employment center, a person needs a passport, work book, pension certificate, documents on professional qualifications and others.
Starting next year, disabled people of the III group will receive hearing aids free of charge. The costs are borne by the state. The funds for the purchase will go from the republican budget. Changes have been made to the law “On social protection of disabled people”. Hearing aids are now in need of 99 people with group III hearing loss. According to the law, free devices need to be issued once every four years. For these purposes, about 500 thousand rubles are needed.
A supplement has been established to the social pension for people with disabilities since childhood. Those who are in the first group of disabilities will receive it in the amount of 125% of the minimum pension. People with disabilities from childhood of the II group, who temporarily need outside help at the conclusion of a medical institution, will be charged an additional 75% of the minimum pension. Disabled children up to 18 years old who temporarily need outside help at the conclusion of a medical institution will be given an increase of 125% of the minimum pension, and disabled children under 18 years old - 75%. If the right to supplements arises on two grounds, one supplement is charged, which is larger.
Help for retirees
An additional amount will be charged to the old-age pension, disability pension, and seniority pension for each year of total length of service that exceeds the required pension. Such additional payments will be established from next year, taking into account the funds of the Social Insurance Fund. They will be received by those pensioners who had a low salary during the working period, but at the same time they have a long record of work.
Persons of retirement age without a group of disabilities can receive free of charge prosthetic and orthopedic products and wheelchairs for personal use, which have arrived in the republic as humanitarian aid. To do this, you need to write a statement to the social protection authorities. The order of issue is determined by the government.
For youth health
Trade of chewing and sucking mixtures containing nicotine is prohibited in Pridnestrovie. The amendments to the current law were initiated by the deputies of the Supreme Council. The goal is to preserve the health of young people, as this type of product has recently become popular among young people. A fine is from 100 to 300 minimum wage (1840–5520 rubles) for the sale of nicotine-containing mixtures. An article of the law spelled out a fine for selling them to minors - from 40 to 120 minimum wages (736-2208 rubles).
Expanding the concept of "large family" and encouraging students
A large family is a family that has three or more children, including adopted and foster children, as well as stepsons and stepdaughters, and raising them up to the age of 18. This status is extended if there are full-time students in such a family, and now if the student is disabled from childhood I, II, III groups and is studying at the correspondence department. In this case, the benefits due to large families will be extended until the end of the students' education, but no more than until they reach 23 years of age. Corresponding changes have been made to the law "On state support for large families".
Vocational education organizations can encourage students who excel in academic, scientific, sports, creative and social activities. The additional cash payment does not exceed the minimum scholarship amount and will be accrued within 25% of the savings of the university scholarship fund. The corresponding norms are now spelled out in the law "On Education".
Small business support
Employees of small and micro-enterprises will receive sick leave payments immediately from the Unified State Social Insurance Fund. The deputies have simplified the previous mechanism. Payments will be transferred to the employee's bank card within 30 days from the date of receipt of the documents. Previously, disability benefits had to wait a long time due to the fact that small and micro-enterprises did not have sufficient financial resources. In addition, the Supreme Council adopted amendments to the legislation in relation to women - individual entrepreneurs. They will receive maternity benefits when they go on maternity leave from 2022. The payment will be 170 minimum wages per month during this period.
Preservation of monuments and cultural values
The Unified State Register of Immovable Cultural Heritage Sites of the Republic includes 19 burial mounds of the Slobodzeya District and the "Mosaic Panel" in the building of the former Bendery bus station. The corresponding initiative of the State Service for Culture and Historical Heritage was supported by the Supreme Council in September. Now these monuments are under state protection, which means that they are subject to the norms of legislation related to the procedures for studying, preserving and restoring.
In addition, objects of cultural heritage can now be included in the state register of monuments if less than 40 years have passed since their inception or since the date of historical events with which such objects are associated. This applies to objects dedicated to the perished defenders of Pridnestrovie or related to military operations to defend the republic. The norm applies to memorial apartments and memorial houses associated with the life and work of prominent personalities who have special services to the Pridnestrovian Moldavian Republic.
The law "On Culture" spelled out the duty of the state - to create conditions for aesthetic education and artistic education of Pridnestrovians. Cultural values should be accessible to people with disabilities, and young talents need a ground for self-realization. The rules governing international cooperation in the field of culture have been spelled out.
Adoption of state target programs
The "Retrofitting of fire fighting service vehicles" state target program for 2021-2029 was adopted. This is due to the need to strengthen the material and technical base of the fire department. The action of the program will ensure high combat readiness of the fire service units and increase the efficiency of organizing fire extinguishing and emergency rescue operations.
The deputies approved the state target program "Immunization of the population of the Pridnestrovian Moldavian Republic" for 2021–2025. The amount of financing is 41 million 760 thousand rubles. The goal of the program is to improve the epidemiological situation in the republic. It is planned in the next five years to cover up to 98% of children with vaccinations within the immunization calendar of the population; to reduce the incidence of viral hepatitis B, whooping cough, mumps; improve laboratory diagnostics of infectious diseases; introduce new vaccines against rotavirus and pneumococcal infections, against cervical cancer caused by the human papillomavirus, and other areas of the program.
The state target program "Prevention of Tuberculosis" for 2021–2025 was approved. The amount of financing is approximately 98 million rubles. The main goals are to stabilize the epidemiological situation of tuberculosis in the republic; timely identify patients with tuberculosis; improve the material and technical base of the laboratory and medical institutions; to raise awareness of the population on the prevention of tuberculosis infection and other goals.
For convenience and transparency
Residential property that remained after the deceased and for which no one claims or can not claim either by will or by inheritance, will immediately pass into municipal ownership. Previously, this procedure was long. The Supreme Council adopted legislative changes simplifying the procedure for transferring escheat property to a new owner.
The law "On the PMR Road Fund" now defines the carrying capacity of a vehicle. This is the mathematical difference between the permitted maximum mass and the mass of the vehicle. The reason for the improvement of the law was the appeals of the heads of enterprises to the Supreme Council. The fact is that there was no such parameter as carrying capacity in the technical passport, although taxes were charged on the basis of the carrying capacity of the vehicle.
Starting next year, most of the state purchases will be carried out in accordance with the new law "On purchases in the PMR". It regulates the supply of products for state needs and is fundamentally different from the law that has been in effect since 1999. Now all government purchases must be made at an open auction. Suppliers can visit the auction site and see the list of goods that organizations need, then offer their prices. Preference will be given to the supplier whose price and quality of the goods will be the most profitable at the auction. The transition to the new procurement system is being carried out in stages. All the remarks that arose in practice were eliminated by the deputies as technical amendments to the law.
Approximately 2000 legislations were submitted to parliament, more than 1500 were adopted as laws in 5 years of work of the VI convocation of the Supreme Council of the PMR. The rest are in the process, or rejected or withdrawn.
