The Laws adopted by the Supreme Council and signed by the PMR President

The plenary session on July 14 completed the spring session of the Supreme Council. It began earlier than usual - in December after the election of the deputies of the VII convocation. Within 7 months, 27 plenary sessions took place, at which about 500 draft laws were considered. The press service of the Parliament prepared a selection of adopted and signed socially significant laws.

 

Salaries, pensions, benefits, supplements

Salaries of state employees and monetary allowances for military personnel and persons equated to them have increased in Pridnestrovie since May 1:

- salaries for employees of state institutions increased by 4%, where the structure has already been optimized according to the pilot project and salaries have increased;

- by 8% - for employees of other budgetary organizations;

- the limits on the monetary allowance of military personnel, employees of the Ministry of Defense, Peacekeeping Forces of the PMR and employees of the State Service for the Execution of Punishments of the Ministry of Justice have increased by 10%.

As a result of the increase in the size of the minimum wage when calculating monetary allowances for employees of law enforcement agencies, the pension provision for these departments increased.

Pensions have increased in the republic since April 1. The minimum retirement benefit is now 693 rubles, which is 33 rubles more than the previously established minimum pension. The size of payments increased by 5% due to the increase in old-age pensions. There are also allowances for seniority. Their size depends on how many people have worked in excess of the period required for calculating the retirement pension.

Mothers who are on parental leave receive a childcare allowance until they reach the age of 2 years from May 1. Previously, the allowance was paid up to 1.5 years. If a child is under two years old, parents can again apply to employers or the social security authorities to receive benefits. It will be paid from May until the child reaches the age of two.

From January 1, 2022, children with disabilities who for health reasons cannot attend educational institutions or day care centers for children with disabilities, will receive a monthly compensation payment in the amount of 45 minimum wage. This is 437 rubles at the moment.

Employees of educational organizations who work with detergents and disinfectants receive salary increments. The Supreme Council adopted amendments and additions to the law on support measures during the period of emergency and quarantine. Previously, the law limited allowances, additional payments to 140 minimum wage. Therefore, the law prescribed that the additional payment is paid separately to these employees. The norm received retroactive effect and became effective from September 1, 2020. The employees were recalculated and paid due allowances.

The anti-crisis law has been amended to abolish the tax on the part of an employee's income that the company allocates for a coronavirus test or medical examination. This money is no longer considered employee's profit. The law extends its effect to legal relations that arose from March 17, 2020.

Enterprise support

The income tax rate for organizations involved in the repair and maintenance of public highways has been reduced from 2.9% to 1.3%. Amendments to the law "On corporate income tax" entered into force at the beginning of this year. The remaining funds of the enterprise can be directed to technical re-equipment and modernization, which should lead to improvement in the quality of road services. The reduced tax rate applies to all road construction organizations.

Another measure of state support is a reduction in the income tax rate for enterprises providing treatment services. Fewer services were performed due to the restrictive measures, but the costs, including the payment of salaries, remained. It was decided as a support to apply reduction factor of 0.4 when calculating income tax for such enterprises. The freed up resources of the enterprise can be directed to solving the current problems associated with the remaining quarantine restrictions. Amendments to the law “On additional measures aimed at stabilizing the PMR economy” were adopted and signed.

Tax incentives for organizations in the footwear and clothing industry continued to operate this year. Reduced coefficient of 1.05 is applied for them to income from services and work on tailoring products from customer-supplied raw materials. The purpose of the law is to prevent deterioration in the performance of organizations in the clothing and footwear industries. The light industry turned out to be one of the most affected industries in 2020 due to the negative impact of the pandemic and due to a significant decrease in business activity in European markets.

Support has been extended to entrepreneurs and organizations whose activities have been suspended due to quarantine until the end of 2021. The amendments to the law on state support measures adopted by the deputies were sent by the President of the of the Pridnestrovian Moldavian Republic of the Pridnestrovian Moldavian Republic in the mode of legislative necessity. According to the law, individual entrepreneurs who have suspended or limited their activities due to the quarantine restrictions can count on recalculation of paid (accrued) tax payments. This is a unified social tax, a compulsory insurance premium, personal income tax, and a tax on potential annual income. It is necessary to submit an application to the territorial tax inspectorates in order for the state to provide such support.

The deputies adopted the law on the support of transport workers. The state will help those who serve socially important routes. Now they are unprofitable for carriers, and people from remote villages cannot get to the regional centers. The situation after the adoption of the law should improve, they are confident in the parliament.

Tax preferences were provided to agricultural organizations and individual entrepreneurs who run a peasant or farm enterprise and suffered serious losses due to the drought of 2020. The Russian Federation rendered gratuitous material assistance to such Pridnestrovian farms. The Supreme Council adopted a legislative initiative, according to which cash payments are not subject to income tax for individual entrepreneurs and a unified social tax for legal entities. Agricultural producers can use the remaining funds to purchase seeds, fuels and lubricants and carry out sowing operations.

Program-targeted financing

Measures to provide oncological assistance to Pridnestrovians continue in the republic. Another five-year state program has been in effect since the new year. They plan to spend more than 200 million rubles on this sphere during 2021-2025. There are expenses for the purchase of medicines, for the implementation of preventive measures, for example, for studies that allow the detection of oncological diseases in the early stages. Funds have been pledged for training and advanced training of doctors and health workers who treat cancer patients.

A number of changes have been adopted to the state program for the support and development of Pridnestrovian tourism. They are aimed at creating new Wi-Fi zones to attract foreign tourists and local residents. This year's budget provided funds for the further development of the website and for the installation of new road information signs of the main Pridnestrovian tourist attractions and routes.

A state target program was approved for preferential lending of Pridnestrovians who are participants in hostilities to protect the PMR and participants in hostilities in Afghanistan from April 1978 to February 15, 1989, who became disabled I or II group of general illness, work injury, occupational disease, disease obtained during military service by people with visual disabilities of I or II groups. The program is designed for 2021–2026. The loan will be provided by the Pridnestrovian Savings Bank. At the same time, 4% per annum will be paid by the borrower, and 13% per annum will be covered by the funds of the republican budget. The maximum loan amount is 25 thousand rubles.

 

Assistance in purchasing housing

The list of applicants for state subsidies for the purchase of their own housing has expanded. The list included employees of the convoy battalion of the Ministry of Justice's internal troops, as well as paramedical personnel of health care institutions and teachers of correctional schools. Previously, these categories were not eligible for government subsidies. In addition, state support can be used by those who did not succeed last year due to the fact that the program was not funded. The reason was the reallocation of funds to fight the coronavirus. This year, state employees who turned 35 last year or whose marriage exceeded 5 years can apply for state subsidy.

From January 1, 2022, for large families who purchase or build housing for the first time, the amount of tax-free income will be 30 thousand minimum wages (312 thousand rubles). Such a benefit, but with a deduction of 10 thousand of minimum wages, applies to all Pridnestrovians since 2001, when the law on property tax deduction came into force. To support large families, the amount was increased threefold.

 

Privileges

Volunteers and students of the Faculty of Medicine of PSU, who are involved in the fight against coronavirus, received the right to travel free of charge on public transport. The corresponding law came into force at the beginning of this year. Benefits are provided for travel in city, suburban and intercity minibuses and trolleybuses. Reimbursement of funds to transport companies is carried out from the republican budget. Volunteers and medical students must have a certificate or a student card or a certificate issued by the Ministry of Internal Affairs.

Donor military personnel were entitled to an additional day of rest. Relevant amendments have been made to the legislation. Previously, they did not have such a right, which placed the military in unequal conditions with other categories of donors.

New laws

On January 1, the law "On land reclamation in the PMR" began to operate in the legal field of the republic. It spelled out the goals and objectives of the development of the reclamation complex. Among them there is increasing the productivity and sustainability of agriculture, ensuring the preservation and improvement of soil fertility, effective state management of the objects of the reclamation system, as well as financing of measures for the restoration and reconstruction of reclamation and irrigation systems. All this is necessary, first of all, to ensure the food security of the republic. the Land Reclamation Development Fund was created on the basis of the law, the financial resources to which come from the targeted collection.

The law "On state genomic registration in the PMR" will come into force in the republic from 2022. The DNA database will first of all help forensic scientists and investigative bodies to quickly disclose committed crimes, more effectively search for missing persons and establish the identity of a person.

Extension of the construction amnesty

The Supreme Council extended the construction amnesty. Pridnestrovians who have not yet registered facilities built or reconstructed in violation of the law can do so until December 31, 2022. They will not be held administratively liable. We are talking about private households built before 2016.

Sick pay

Unemployed Pridnestrovians who are quarantined for COVID-19 with children under the age of 8 can receive temporary disability benefits. This applies to citizens registered with the Employment Centers. In the event that a kindergarten or group is quarantined due to coronavirus, an unemployed parent can count on social support from the state. Changes to the anti-crisis law apply to legal relations that arose from March 17, 2020.

Creditors' guarantees

A law came into force aimed at securing guarantees of creditors of the reorganized legal entity. The procedure for carrying out control measures by tax authorities after the corresponding notification is published. Information about the reorganization is entered into the state register of legal entities. Legislative innovations will allow creditors to take timely measures to protect their interests.

In the interests of voters

Such a document as a deputy's act was enshrined in the law. Previously, it was often used in practice. Deputy of the local Council, representing the interests of the voter, records any information. For example, whether a person has lost the right to use a residential building and whether building materials are really needed for personal use. A deputy's act can be presented to various state authorities to confirm the information.

At the time of military training, employees of organizations or enterprises will retain the size of their average wages. It is planned to pay it during the collection period at the place of work at the expense of funds allocated for these purposes from the republican budget. Previously, those who were called up for military training received a salary in the amount provided for the corresponding categories of military personnel doing military service under the contract. The level of pay for contract soldiers often turned out to be significantly lower than the average earnings of those called up for military training.

Strengthening of personnel

This is due to a shortage of personnel in fire departments. In recent years, the load on firefighters has been growing, and the number of departures has been increasing. Previously, only persons who had served in the army could be admitted to the State Department for Emergency Situations. Now those with a professional education can enter the service of the fire or emergency rescue service. They are granted a respite from the army for the period of their work.

Amendments to the Administrative Code

Drivers will not pay a fine for a forced collision on solid lines on the roads. This applies to avoiding obstacles, for example, pits, parked cars, repair work. The initiative was developed by a group of deputies of the Supreme Council on the basis of requests from drivers.

Amendments to the Code of Administrative Offenses entered into force. They were developed by the deputies of the Legislation Committee on the basis of request from the State Service for Environmental Control and Environmental Protection. In order to exclude misunderstandings, a new definition of the concept of gross violation of fishing rules has been given. The adopted law also weakens responsibility for violation of fishing rules by establishing such a measure as a warning.

Online approach

Pharmaceutical organizations have the right to sell medicines and other pharmaceutical products remotely from January 1 of this year. Adopted by the Supreme Council and signed by the President of the amendments to the law "On pharmaceutical activities in the PMR". The introduction of this service was caused by the action of quarantine measures. The law-in-draft is based on the norms of the Russian law.

Financial, tax and statistical reporting in electronic format for business entities will be required from January 1, 2022. On the one hand, submission of reports is simplified for entrepreneurs, on the other hand, the state can reduce the cost of processing a large amount of paper information. The unified information system at the moment is working in a test mode and enterprises have a choice whether to submit reports in paper or electronic form.

Public hearings can be held online. This possibility was enshrined in the law due to the action of restrictive measures to prevent the spread of coronavirus. The law prescribes the procedure for notifying all interested parties. This will keep the publicity and reach the broad masses of the public. When considering the reports of local budgets, annual reports on their implementation and issues that are submitted to hearings, it is necessary to submit documents not only on paper, but also in the form of a presentation - visual diagrams, manuals, using modern technology. This will make it clearer for the public where and how the money is spent.

The interaction of individual entrepreneurs with tax authorities has been simplified. All information about the entrepreneur and the conditions of his activity is contained in an individual electronic document. This experiment in tax administration is being conducted on a voluntary basis. Information about the individual entrepreneur can be obtained by scanning the entrepreneur's QR code. A card is also used to pay taxes online. The new interaction system allows individual entrepreneurs to deduct tax payments and notify tax authorities about it in real time. The law is valid until the end of the year. During this time, experts will assess its effectiveness. If the experiment shows good results, it is possible that the rule of the law will be extended for the next year.

Pridnestrovians will be able to apply to the Constitutional Court not only in writing, but also using an electronic document signed with an electronic signature. A special form can be filled out on the official website of the court. The innovation will ensure the convenience of citizens applying to the Constitutional Court.
