The Government proposed allowing residents of villages and towns to register and formalize rights to land plots for gardening and personal subsidiary farming without paying state duty. The author notes that land plots for gardening and personal subsidiary farming are mainly used by pensioners, as well as those for whom "work on the land" is the main source of income. Many do not register rights to land plots due to the need to pay state duty. Therefore, the abolition of state duty for residents of villages and towns will be an incentive for compliance with the established procedure for using land plots and registering the right to use vegetable gardens and land plots for personal subsidiary farming, according to the Government. The amendments to the law "On state duty" propose to exempt residents of villages and towns from paying state duty levied:
1) for registration of contracts (transactions) with land plots provided for the purposes of gardening or personal subsidiary farming and for issuing documents on this registration;
2) for registration of rights to land plots provided for the purposes of gardening or personal subsidiary farming.
The Government proposed to cancel the payment of state duty for the period from January 1, 2025 to July 1, 2025. Deputies of the Committee on Agro-Industrial Complex Issues proposed to extend this period until the end of 2025. The law-in-draft will be submitted for consideration by the deputy corps in two readings at once, taking into account the amendment of the Committee.
The explanatory note to the law-in-draft states that state registration and systematization of the powers of land users will be ensured If the amendments to the law "On state duty" are adopted. The current provisions of the Land Code stipulate that rights to land as well as transactions (agreements) with land must be registered by entering the relevant information into the Unified State Register of Rights to Real Estate and Transactions with It.
