The deputies of the Committee on Legislation, Protection of Rights and Freedoms of Citizens in the course of their meeting considered specialized legislations, which will soon be considered by the Supreme Council in the first or second readings.

Thus, the deputies of the Committee are in favor of adopting in the first reading the law-in-draft on amendments to the Criminal Code. The author of the initiative is President Vadim Krasnoselsky. The PMR President proposes toughening criminal liability for repeated violation of traffic rules by drivers under the influence of alcohol. This means that at the time of the offense, they had already been subject to administrative punishment for drunk driving or had a criminal record for causing harm to health or death to a person as a result of violating traffic rules while deprived of the right to drive a vehicle.

Vadim Krasnoselsky considers it is necessary to prescribe the possibility of confiscating cars from such offenders as an additional type of criminal punishment. The car belonging to the convicted person and used by him to commit a crime under Articles 260-1 and 260-2 of the Criminal Code will be subject to confiscation ("Violation of traffic rules by a person subject to administrative punishment or having a criminal record" and "Driving a vehicle by a person deprived of the right to drive vehicles and having a criminal record").

The explanatory note to the law-in-draft provides statistics from the State Traffic Inspectorate of the Ministry of Internal Affairs. 3166 accidents occurred in Pridnestrovie in 2021, of which 88 accidents occurred due to the fault of drunk drivers in a state of intoxication. As a result, 2 people died and 15 people received injuries of varying severity. 70057 traffic violations were identified, 900 drunk drivers were detained, including 68 people in a drug-induced state. There were 2798 road accidents in the republic in 2022, of which 92 were due to drunk drivers, 1 person died, 18 received injuries of varying severity. 70305 traffic violations were identified, 915 drunk drivers were detained, including 78 drug-impaired drivers.

2780 road accidents occurred in 11 months of 2023, 114 of which were due to the fault of drivers driving vehicles while intoxicated.

1 person died and 18 people received injuries of varying severity. 67331 traffic violations were identified, 809 drunk drivers were detained, including 54 drug-impaired drivers.

According to the President of the Pridnestrovian Moldavian Republic, such statistics indicate the insufficient effectiveness of the current measures. According to the current criminal law, Article 260-1 prescribes a fine of 200 to 500 minimum wages, mandatory or correctional labor, or imprisonment for up to 3 years. Article 260-2 provides for a fine of up to 600 minimum wages, mandatory or correctional labor, or imprisonment for up to 2 years. If the possibility of confiscating vehicles is included in these articles of the Criminal Code, the number of violations may decrease, the author of the law-in-draft considers.

The Committee deputies decided to recommend the law-in-draft on toughening criminal liability for malicious violators of traffic rules for adoption in the first reading at a plenary session of the Supreme Council.

Another initiative of the President was supported for adoption in the first reading, which proposes to enshrine at the level of law the norms regulating the provision of vacation leave to cadets of military educational institutions of professional education. They want to stipulate that the terms will be determined by the Regulation on the procedure for military service in the law "On the status of military personnel". Winter vacation is up to 15 days, summer is up to 30 days.

The deputies of the relevant committee prepared two legislations concerning enforcement proceedings for the second reading. We are talking about the creation and introduction of an electronic database that would contain information necessary for the compulsory execution of judicial acts, as well as enforcement documents. They want to include in the Law on Enforcement Proceedings a ban on collection under enforcement documents if, after deductions, the debtor's income is less than the subsistence minimum. All legislations considered at the Committee meeting will be considered at one of the plenary sessions of the Supreme Council.
