The Committee on Legislation is working on two bags of prosecutorial initiatives. One of them involves the introduction of amendments and addendum to the laws "On Prosecutor's Office" and "On local government and public administration in Pridnestrovie", as well as in the Administrative Code of Arbitration Procedure and Civil Procedure Codes. Presenting the legislations, Alexander Deli said that their development is driven by the need to eliminate a number of existing contradictions. It is proposed, for example, to supplement the constitutional law section, which contains all the rules on acts of prosecutorial response, and requirements to them. Another proposal related to the fixing at the legislative level responsibilities appeared when summoned by the prosecutor and provide explanations on the issues of the audit. It is also proposed to increase the period of citizens on appealing the decision from six months to a year. One of the innovations initiated due to the powers of the Prosecutor's Office to oversee the execution of the Central Executive Committee and the Central Bank of the Constitution and laws of PMR.
The proposals, taking into account the numerous comments, were supported by the profile committee. Only the initiative on introduction of amendments proposed by the Prosecutor's Office of the Law "On local government, local government and public administration in Pridnestrovie" did find the support of committee. The unequivocal answer to the question of who should apply to the court to challenge the decisions - the prosecutor's office or the local council - was not given. The Committee will recommend this location to dismiss. The prosecutor office, possibly after further study the issue, decides to withdraw it.
Another set of initiatives presented by the Prosecutor's Office of PMR was designed to improve the rules of criminal procedure legislation. This is a clear delineation of functions of prosecutor's supervision and preliminary investigation. The authors refer to the Russian practice. The package of four legislations was presented. One of them - is the draft law on the introduction of the new version of the Criminal Procedure Code of PMR. The current one, according to prosecutors, is obsolete. According to the explanatory memorandum, more than two dozen amendments and additions were made to the Code from 2013. The new version was developed on the basis of Russia's equivalent of taking into account the realities of Pridnestrovie. One of the most important issues in the initiative - is presentation of public prosecution in court. Today, these powers are assigned to the Investigative Committee, the Prosecutor's Office insists on returning to the function.
This profile committee recommended a package of initiatives for adoption in the first reading, but the main work on the law-in-draft continues. If deputies support it, the working group will be created.
