Initiative of the President on introduction of the project of the law "On international contracts of PMR" to the legal environment of the Republic is placed for consideration of the Supreme Council. The aim of introducing the law-in-draft is to consolidate the powers of the government and other public authorities of the republic in the sphere of formation of the international legal framework, taking into account the constitutional reform generated by 2011 in part of the redistribution of powers authorities. The draft law is preparing for the second reading. Parliamentary committee on legislation considered received amendments that were submitted to a plenary session. The discussion was rolled over the issue of conservation of the Supreme Council of the right to take a decision on the recognition of the international contract in framework of the law. It was decided to postpone a decision on the law-in-draft by including it in the agenda of the next plenary session for detailed consideration of this issue.
Today's meeting of the profile committee was devoted to the consideration of this document, or rather, its amendments. One of them was offered by prosecutors. The position of the prosecutor regards the distinction between the Supreme Council, the President and the Government authority for the recognition of the international treaty framework rule of law, and it is specified that the Parliament will be entitled to that right, if necessary, changes in legislation or if there is a contradiction of the provisions of the international treaty the domestic law of the republic.
It was discussed in the course of the meeting that today the Supreme Council has the right to ratify the treaty after it is signed by the President or the Prime Minister. The current law in the proposed draft of the new law provides a list of agreements on which Parliament can take a decision. These are documents of an international character, for the recognition of the rule of law framework which is necessary to make changes to the PMR legislation and international treaties relating to matters of war and peace or affect the rights and freedoms of individuals.
Discussion by profile committee of proposed amendments prosecutor's office came down to the fact that the Supreme Council is empowered to participate in the recognition of the international treaty framework rule of law only in exceptional cases. The relevant committee deputies opinion was divided.
Deputies votes re equally divided at the end of the discussion of the issue. Deputies will determine the fate of the initiative at the forthcoming plenary session.
