Improving payment discipline of debtors

The Committee on Regional Policy, Local Government and Housing and Public Utilities has prepared law-in-draft of the Government on increasing payment discipline of debtors to organizations providing utility services for consideration in the second reading. The initiative speaks of introducing such a measure as temporary restriction of electricity supply to a debtor, in the event of failure by the debtor to fulfill within the established period without good reason the requirements contained in the enforcement document on debt collection for heat supply, water supply and sanitation (sewerage).

The amendments propose to establish that temporary suspension of electricity supply to the debtor is impossible if large families, single parents, disabled persons of groups I and II, orphans and children left without parental care, as well as persons from among orphans and children left without parental care are registered at the place of residence or stay in the premises. Taking into account the amendments, the Committee on Regional Policy has prepared a bill on amendments and additions to the law "On Enforcement Proceedings" for consideration by the deputy corps in the second reading. If adopted, the law-in-draft will enter into force 3 months after the official publication. In addition to the government law-in-draft, deputies of the Legislation Committee Galina Antyufeeva and Grigory Dyachenko proposed to supplement the Civil Procedure Code of the PMR with a new article regulating the procedure for establishing a temporary complete restriction on the supply of electricity to the debtor by the court. This article proposes to prescribe the criteria for filing an application for temporary complete restriction of the debtor's electricity supply, the time frame for consideration of the application by the court and the circumstances that must be taken into account when making a decision. The profile committee decided to recommend the proposed law-in-draft for adoption in two readings.
