The Supreme Court of the Pridnestrovian Moldavian Republic has initiated law-in-draft to amend the law "On State Duty", based on judicial practice. The author proposes to exempt citizens from paying state duty on cassation and supervisory complaints in the following cases:
- on referral to a medical-labor dispensary;
- on extending the period of stay in a medical-labor dispensary;
- on involuntary hospitalization in a psychiatric institution (hospital) or on extending the period of hospitalization;
- on involuntary psychiatric examination;
- on compulsory hospitalization in medical anti-tuberculosis organizations for mandatory examination and (or) treatment.
The Supreme Court explains the need to exempt this category of citizens from paying the state fee by the fact that in most cases, cassation and supervisory appeals against court decisions are returned to them, including due to non-payment of the state fee. They cannot pay it, since they are in closed institutions undergoing labor education and compulsory treatment.
The law-in-draft emphasizes, the citizens will be guaranteed the right to judicial protection despite the abolition of the state fee. The amount of the state fee itself is about 25 rubles, therefore, the financial burden on the budget will be minimal, given the insignificant number of appealed court decisions per year, according to the author.
The Supreme Court's relevant committee recommends adopting the law-in-draft in the first reading.
